"...By our count, armed citizens stopped 36.6 percent of the active-shooter incidents identified over those twelve years, nearly ten times the FBI’s 3.9 percent. Over the most recent five years, that figure rose to 42.5 percent. The percentage rises further when we consider only places where law-abiding citizens may legally carry firearms. After all, you can’t expect armed civilians to stop many attacks in places that prohibit them from carrying. Outside gun-free zones, we estimate that armed civilians stopped 56.3 percent of active-shooter attacks over the past five years..."
Yes, Armed Civilians Can — and Do — Stop Mass Shootings: Data ignored by the FBI show the importance of defensive gun use in bringing down active shooters Two days after last week’s attack on an Oregon elementary school, the @AP opened a news story with a familiar claim: “Few mass shootings in the U.S. end like the deadly attack on an Oregon elementary school: with an armed civilian opening fire on the gunman.” crimeresearch.org/2026/10/at… #2a #guns #GFZ #gunfreezone

This needs to be fixed!
After spending nearly FOUR YEARS in federal prison for committing no crime, I’ve learned patience. But patience has its limits. They were quick to arrest me. Quick to raid my home. Quick to seize my property. Quick to strip me of my Freedom and Constitutional rights. Yet nearly TWO MONTHS after receiving a FULL and UNCONDITIONAL Presidential Pardon, I’m still being denied the ability to purchase a firearm. The government wasted no time taking my rights. Why is it taking so long to restore them? Every day I’m wrongfully denied the ability to exercise my God-given Second Amendment rights is another day my Constitutional rights are being violated. JUSTICE DELAYED IS JUSTICE DENIED. Thank you, Lee Williams @HT_GunWriter , for exposing this continued government overreach.

New Investigative Journalism Project Article by @HT_GunWriter! "As arsonists, rioters and looters swarmed the streets of Paris Sunday night, French police were completely ineffective and President Emmanuel Macron and his wife were off attending a concert, which featured Céline Dion. Well-planned rioting and thievery are taking place throughout France and other European countries. Some say the actions are coordinated by the extreme far left and will continue unabated. France is still six months away from its next presidential election. Europe is on fire. Its victims are on their own. Extreme anti-gun laws throughout the continent have helped fuel the fires. France has some of the strictest anti-gun laws in the world. For a permit to purchase a “sporting arm”—not a handgun or a semi-automatic rifle—the applicant must be 18 years old and possess a valid hunting license or a shooting club membership. The applicant must also have completed and passed a medical exam, a mental health exam, an extensive criminal background check and government-approved firearm safety training. Once they’ve completed all of these legal requirements, they are required to submit an application to their local police. This alone can take months or even years. Many applicants have been rejected for no reason. Even if they manage to pass the requirements and purchase a firearm, concealed carry is outlawed. Gun safes are required. Ammunition must be stored separately, and law enforcement can conduct an in-home inspection whenever they want..." Read the full article here: saf.org/europe-on-fire-prove…

Inefficient bureaucracy or something else? Either way, this should be fixed right away!
Presidential pardon recipients still barred from buying guns The Federal Bureau of Investigation has denied recent firearm purchases by both Pastor Russell Fincher and Patrick “Tate” Adamiak who were each pardoned by President Donald L. Trump nearly two months ago. Adamiak tried to purchase an Auto-Ordnance semi-automatic Thompson, which had engraved images of President Trump. Fincher tried to buy a Smith & Wesson Victory handgun. Each completed an ATF Form 4473, but each was denied by the FBI. Both Adamik and Pastor Fincher received Presidential pardons, which were signed by President Trump Sept. 3, 2026, but neither man’s Second Amendment rights appear to have been fully restored. ATF Director Robert Cekada was quick to point out that his agency had nothing to do with the denials. “I am fully aware of that, but it has nothing to do with us,” Cekada said Friday morning. “We don’t block anybody. The 4473 goes to the FBI. Anyone who gets a denial on a background check gets denied by the FBI.” The FBI requires members of the media to submit their question via email. Questions were sent Friday morning, but so far, the agency has not called or sent a response. “It’s frustrating,” Fincher said Friday morning. He ordered the Smith & Wesson handgun through a local dealer. “I told him he’s going to have to sell it to someone else,” Fincher said. “If I want to buy a firearm, I guess now I have to buy it from an individual.” Adamiak said he also experienced problems with a denial by the Pennsylvania State Police instant background check system. “I filled out an appeal and mailed it to the state,” he said. “They won’t accept digital submissions, and they have up to 30 days to make a decision.” The state and federal systems are not communicating, he said. “We’re both cleared,” Adamiak said. “Every day we can’t get a firearm is a day we can’t defend ourselves. Our Second Amendment rights are being violated. We each have presidential pardons.” The Second Amendment Foundation’s Investigative Journalism Project wouldn’t be possible without you. SAF and partners have filed a motion for a preliminary injunction against New Mexico’s 7-day firearm waiting period. The Tenth Circuit already held the law unconstitutional for people who pass a federal background check. The district court entered judgment for the two individual plaintiffs in the earlier Ortega case. New Mexico has taken the position that it can keep enforcing the law against everyone else. This motion asks the court to stop that. The waiting period is a pure cooling-off delay, not a background-check process, and the Tenth Circuit has already said that violates the Second Amendment. **Link here - saf.org/wp-content/uploads/2…

SAF and the National Rifle Association have filed an amicus brief in United States v. Cordova, urging the Fifth Circuit to adopt a dangerousness standard to challenges of lifetime federal firearms bans. The case returns to the Fifth Circuit after the court granted rehearing en banc and vacated the panel opinion. The brief filed today urges the court to hold that historical tradition supports disarming only dangerous persons – those with a proven proclivity for violence or who pose a threat to the government – not every person convicted of a felony. Colonial and Founding-era restrictions targeted the dangerous. Militia laws required able-bodied men to keep arms and contained no exemption for prior nonviolent convictions, and some statutes even expressly protected criminals’ arms from seizure. “History disarmed the dangerous, not the peaceable,” said SAF Director of Legal Research and Education Kostas Moros. “A nonviolent felony is not a lifetime forfeiture of the right to keep and bear arms.” The brief also rejects the metric, adopted in an earlier Fifth Circuit decision, that treats a lifetime ban as justified whenever the predicate offense was a felony punishable by death at the Founding. Many Founding-era felonies were not capital. Those who completed their sentences were not left disarmed – they were often required to bear arms under the militia acts. Using historical eligibility for the death penalty as a proxy for permanent disarmament would treat the Second Amendment as a second-class right, since no other Bill of Rights guarantee is forfeited on that basis. “There is no tradition of permanently stripping the right to keep and bear arms from peaceable citizens, including nonviolent felons who completed their sentences,” said SAF Executive Director Adam Kraut. “The Fifth Circuit should make clear that dangerousness, not the mere existence of a felony conviction, is the standard. Peaceable Americans who have paid their debt to society should not be forced to surrender their right to keep and bear arms for the remainder of their lives.” Read about it here: saf.org/saf-nra-file-amicus-…

The basis for states passing broad "sensitive places" laws (also known as "gun free zones") is that supposedly, having armed citizens in such places is fundamentally dangerous. That belief is not based on reality. As our new factsheet shows, state-level government data proves that Americans with carry permits are overwhelmingly law abiding, committing crimes at a rate many times lower than the general population. As some of the examples we highlight demonstrate, they have also occasionally been called upon to save lives in horrifying situations, and they rose to the occasion to do just that. Laws that focus on disarming such law-abiding individuals are fundamentally misguided and should be repealed. As we also argue in several of our active cases on this topic, if the government wants to declare a place "sensitive" and off-limits for legal carry, it should be expected to provide comprehensive security at such locations.

Thread done on both briefs here. It's long, enjoy. One last thing to note. Cook County argues repeatedly that AR15s are bad for self-defense, and pistols are better for that purpose. Chicago argued exactly the OPPOSITE in defending its handgun ban in McDonald (another SAF case!). From their briefing in that case:
Cook County and Connecticut have just filed their briefs in Viramontes and Higgins. This thread will look at the Cook County brief first. To the extent the Connecticut brief differs in substance, we'll cover that here too.

This was basically a better-written version of the Cook County brief, but loaded with the same huge problems and some new ones not present in that other brief. Excited for our reply brief and oral argument!
