Dr. Capo Martinez: "No." Dr. Capo Martinez: “I was not asked to consider whether this was a homicide.” The prosecution asked would you have done anything different? Dr. Capo Martinez: “probably the processing of the body and the collection of the evidence.” Dr. Capo Martinez told jurors she has probably only changed a death certificate once or twice in her career. She said new information came to light. The cause was changed to asphyxia and manner was changed to undetermined. Prosecution: “Who if anybody pressured you to change the death certificate?” Dr. Capo Martinez : “I was not pressured to change the death certificate.” Dr. Capo Martinez told jurors "Undetermined" is used in cases where there may be multiple manners of death considered and can’t be excluded.

Dr. Capo Martinez described Birchmore's body as “seated and leaning upwards.” Prosecution: “Did you take steps to preserve the hyoid bone?” Dr. Capo Martinez: “Yes.” In October 2024 the hyoid was taken out and photographed. Dr. Capo Martinez said it was at the request of the FBI. Prosecution: “What direction was that hyoid bone fractured in …pushed in toward the center? Dr. Capo Martinez: “Yes.” Prosecution: "Who requested it be sent out for further imaging" Dr. Capo Martinez: "I believe the FBI." Dr. Capo Martinez: “The only other significant finding was gallstones, stones in her gallbladder and the intrauterine pregnancy.” Prosecution: “Any signs of a miscarriage?” Dr. Capo Martinez: “No.” Dr. Capo Martinez: “I measured the fetus to be 3 centimeters long…8 to 10 weeks.” Prosecution: "Did the fetus die when Ms. Birchmore did?" Dr. Capo Martinez: “Most likely given there were no signs concerning a miscarriage.” I had requested scene photographs, I got my toxicology report back, and MSP said there was nothing more to add. 90 days after the autopsy Dr. Capo Martinez said, “I felt comfortable closing the case.”
