PJM announced that it intends to refile its Reliability Backstop Procurement on Oct. 29, with CEO David Mills focusing on the need for immediate action. FERC in September delayed the implementation of the procurement for five months to further evaluate how the proposal would assign costs to load-serving entities, determine the exit rules for transmission owners requesting to leave the RTO, as well as collateral requirements for LSEs. PJM hopes to have those questions answered, while it also evaluates FERC’s order rejecting its Interim Resource Adequacy Service proposal, which will take much more time to figure out, Mills said.

With the Bipartisan American Affordability and Jobs Act lying in limbo in Congress, ACORE’s Grid Forum focused on the legislation and what it might mean for the future of permitting. Industry members spoke on the potential changes, including where and how the growing demand from data centers fits in.

The MISO Advisory Committee made its voice heard when it comes to the best practices review of the Independent Market Monitor, saying the committee that “advises” should at least have its voice heard in the matter. The group also raised some questions for consulting firm EY-Parthenon to consider as it continues the review.

A special joint meeting of the NYISO Business Issues and the Operating committees failed to fully endorse the ISO’s framework pertaining to FERC’s large load show-cause order, with the OC’s vote of 54.84% falling just short of the 58% needed for advancement. While stakeholders commended NYISO for working to meet FERC’s deadline, some sectors completely abstained from voting while NYPA and the NYSERDA voted against it. The Members Committee will consider the tariff revisions next week.

RTO Insider’s Michael Cade has more from the Ontario Energy Conference that took place in Toronto last week, including data center developers expressing more concern about potential restrictions to grid access than higher electricity rates. With legislation passed last year that gave the province the authority to establish grid connection requirements, some wondered if there is a need to have separate restrictions for the large load users.

During a third-quarter earnings call, NextEra Energy CEO John Ketchum talked about his company’s proposed merger with Dominion Energy just days after the Virginia State Corporation Commission heard testimony on the deal. Ketchum said he believes the case will come down to affordability, job creation and clean energy, and that NextEra has put forward a strong case in each of the areas.

The word of the day at FERC’s reliability technical conference on Oct. 21 was “flexibility,” as the day turned into a discussion on how to reliably integrate data centers onto the grid. Speakers from around the nation spoke on the rapid rise in demand from data centers and said the facilities must be flexible with their energy use in order for the system to hold up. PJM’s Christopher Pilong and Emerald AI CEO Varun Sivaram were among those who offered their thoughts.

For the second time in a month, FERC rejected TransAlta’s proposal to recover costs from the continued use of Unit 2 of the coal-fired Centralia Power Plant in Washington state. TransAlta sought to recover nearly $6.4 million in costs related to DOE emergency orders to keep the unit operational between March 17 and June 14. The ruling mirrors an earlier one in which the commission denied a $20 million request, saying the company should instead seek compensation from load-serving entities throughout the Northwest.

Parties made their arguments to the 9th U.S. Circuit Court of Appeals in relation to spill levels at Northwest dams and attempts to protect migrating salmon. In the case, which span two decades of litigation, the Department of Justice said an earlier decision to allow a 24-hour spill would actually harm the salmon, while a representative from Earthjustice said the government’s plan would increase survival rates by just 0.1%. Through it all, the Bonneville Power Administration said it may have to raise power prices to mitigate a potential $250 million shortfall stemming from the original order.
