Seventh Circuit: Deputy Involved in Fatal Crash Gets Qualified Immunity l.facebook.com/l.php?u=https…
A Milwaukee County sheriff’s deputy whose distracted driving resulted in a fatal accident has qualified immunity, the U.S. Court of Appeals for the Seventh Circuit decided in Estate of Stinson v. Streicher.
It’s the first case to decide whether inattentive driving could violate substantive due process under County of Sacramento v. Lewis, 523 U.S. 833 (1998).
“Officer Streicher’s distractedness — regardless of the source — was negligent, perhaps even grossly negligent; it was not obviously unconstitutional,” wrote Judge Diane Sykes on a panel that included Judge Kenneth F. Ripple and Judge Amy J. St. Eve.
The decision reverses Judge J.P. Stadtmueller of the U.S. District Court for the Eastern District of Wisconsin.

Nearly half of all lawyers are burned out. How can we as a profession address it?
The largest study of lawyer mental health ever conducted – surveying roughly 37,000 actively licensed attorneys – reveals a profession under strain. Full story below.👇
Nearly half of lawyers (47.4%) screen positive for high burnout, and more than 41% screen positive for risky drinking. Yet only 2.3% report an alcohol use disorder diagnosis, pointing to a troubling gap between risk and help-seeking.
These numbers also hit close to home: 41% say their time in the profession has been detrimental to their mental health, and 27% have considered leaving due to burnout or stress. Solo practitioners and private firm lawyers face the highest predicted rates of distress.
"It is obvious we face meaningful challenges and heightened risk, but the opportunities and desire for change that this study reveals appear equally robust. Especially now as the profession navigates the significant uncertainties and changes brought by the proliferation of AI, it is more important than ever for the well-being of lawyers to be a truly central priority." – Patrick R. Krill, study co-author
The good news: 81% of lawyers say the profession should focus greater effort on mental health and substance use. Change starts with awareness – and this study delivers it.

A great message from Pro Bono Lifetime Achievement Award recipient Michael Levey.
Five decades after a legal services internship shaped his career, Levey urges lawyers to help close the justice gap through service, funding, and reform.
Number 1 on his list: Provide pro bono legal services.
"Not sure where to start? Contact a legal services provider, like Legal Action of Wisconsin, to see how you can pitch in. Or check out the State Bar of Wisconsin’s pro bono portal for opportunities in your practice area and community.
Finally, clerks of courts and pro se help desks might help identify pro bono opportunities that are a match for your skill set. And, as a bonus, Wisconsin attorneys can receive continuing legal education credit for providing qualifying pro bono legal services."
Thank you, Atty. Levey, and to all those who regularly provide pro bono legal services to their communities!
