As construction disputes grow more complex, parties are using mediation not only to settle cases, but also to exchange information, assess risk, and keep projects or business relationships moving. At the 2026 AAA Construction Conference, panelists examined how construction mediation is evolving and how the mediator’s role is expanding. The message for construction teams: mediation does not need to wait until the eve of arbitration or trial. Used earlier and more strategically, it can help parties manage cost, clarify risk, and resolve disputes before positions become more entrenched. Great organizations tend to share a common trait: restlessness. When circumstances shift, they reinvent how they deliver. For many organizations, those moments of hard change come during times of upheaval. For the AAA, that moment came in the 1990s with the launch of its Case Management Centers. By the 1990s, the AAA was doing things in ADR that few others had dared, including expanding globally. But first, it needed to prove that it could streamline case administration at home. Discover how did they accomplished this feat here: adr.org/100-years/our-storie… #AAA100 #Arbitration #CaseManagement

In the AAA’s 2026 Construction Report, Denise Motta, Counsel at Wilson Elser, emphasized that force majeure provisions are only as useful as the contract language and the process the parties follow when a disruption occurs. She continued, saying that notice should do more than preserve a party’s rights. It should also start a practical discussion about how the force majeure issue will be addressed before it causes broader project impacts. Nowadays, professionals in the construction industry are looking for ways to address issues before they evolve into formal disputes. This is where Dispute Avoidance and Resolution Boards (DARBs) come in. DARBs, which typically consist of one or three highly experienced neutral professionals with relevant expertise, are uniquely positioned to provide real-time issue resolution at any point in a project’s lifespan. They can provide a structured framework for helping project participants resolve issues early, preserve relationships, and maintain project momentum before disputes escalate into costly and time-consuming post-project disputes.
