After David Eby's desperate, callous attempt to use the soldiers killed over the weekend to attack his political opponents, Eby is now in damage control mode.

BALDREY: David Eby just phoned me a few minutes ago, Julie, to clarify his comments. He said he had no intention to use the death of the soldiers in a political fashion. That was not what he meant to talk about today. But he's going to be clarifying his remarks at a campaign stop later today in the Okanagan. So obviously an issue that is suddenly blown up in the campaign. And Eby is going to clarify his remarks later today.
In Canada, a stay of proceedings does not mean someone is innocent. It means the legal proceedings have been halted, either temporarily or permanently, depending on the circumstances.
If you're talking about a criminal case, there are several possible reasons for a stay, and the distinction matters.
What a stay of proceedings can mean:
1. There wasn't enough evidence to proceed.
The Crown prosecutor may decide that the evidence is insufficient to justify continuing the prosecution. Depending on the circumstances, the Crown may enter a stay rather than proceed to trial.
2. A key witness refused to testify.
If a witness refuses to testify or changes their story, that can seriously weaken the prosecution's case. However, it does not automatically require a stay. The Crown must consider whether other evidence is available and whether the case can still proceed.
3. The accused person's legal rights were violated.
A court can order a stay if the prosecution would amount to an abuse of process, such as in certain cases involving serious violations of the accused person's constitutional rights. This is an exceptional remedy.
4. The Crown decided to stop the prosecution.
The Crown can enter a stay for various reasons, including evidentiary problems or other public-interest considerations. Under Canada's Criminal Code, a Crown-entered stay can generally be recommenced within one year, subject to the applicable rules. If it is not recommenced within that period, the proceedings are deemed never to have been commenced.

That alone does not automatically mean the accused gets a stay. If the witness is essential and the Crown cannot prove its case without their testimony, the prosecution might decide it cannot proceed. But the outcome depends on the available evidence and the circumstances.
What does it mean for the accused?
💥💥A stay is not the same as an acquittal. The accused has not necessarily been found innocent, and there may not have been a trial or a determination of guilt.💥💥
Under section 579 of Canada's Criminal Code, the Crown can generally restart a stayed prosecution within one year, subject to the statutory time limits.
If it does not, the proceedings are deemed never to have been commenced.

In 2006, I was celebrating Canada Day in a public park. An incident with which I had nothing to do with occurred, and I was mistakenly accused of being involved. I was falsely accused, and when the Crown prosecutor realized that, the charges were stayed. I was innocent, and thankfully the Crown finally realized that.
I have no criminal record, and have undergone multiple criminal record checks while running for public office.
It is disappointing that political opponents are seeking to revive a false accusation from 20 years ago to attack me. I have been an upstanding member of the community, a loyal father and husband, and a proud British Columbian seeking to serve his community.
In Canada, one is presumed innocent until proven guilty - not the other way around, as my political opponents would seemingly prefer. I'm confident that British Columbians will see these despicable tactics by opponents for exactly what they are.

This man has the AUDACITY to call out Conservatives while the NDP’s record in BC speaks for itself. Years of questionable decisions, spiralling costs, and failures in managing this province have left British Columbians paying the price.
His performance during the last fire season deserves serious scrutiny, and the NDP’s spending, deficits, and growing debt demand accountability.
Before pointing fingers at the opposition, perhaps he should answer for his own government’s record.

At the end of this election it will proved to have been about basically nothing between the 2 major parties. Just changing of the guard but no big ideological breaks.

Ignored the lies against Heather Mahss and failed to have her back.
Missed the opportunity to call out the two NDP MLAs whose comments about white people sparked accusations of racism.
Allowed the jabs about being Christy Clark’s lapdog to go unanswered.
And this is the man who replaced KLF because she supposedly wouldn’t be strong enough to debate Eby?
Here’s the problem: when things get SO bad under an NDP government, people become desperate for change. They’ll vote for almost ANYONE if they believe it’s the only way to get rid of the government they’re fed up with.
Even a Liberal wearing a Conservative mask.
That’s how political accountability gets lost. People stop asking who they’re voting FOR and focus entirely on who they’re voting AGAINST.
