Level 1: This procedure is impossible.
Level 2: Wright & Miller? What's Wright & Miller.
Level 3: Wright & Miller are collectively the Patriarch of All Federal Rules.
Level 4: Wait they are really opinionated and say a bunch of stuff I'm not sure is right.

Sad news. He was a great lawyer and a great person.

40‘s the minimum number of members for a Rule 23 class action. Not saying this would be a good class, but that’s probably the reason for the number.
Usually a plaintiff will just plead the language: “so numerous as to make joinder impracticable.”
Replying to @RMFifthCircuit
Flores says there are 40 potential class members. Again, I don't know the strategy here, but given how unwilling some of those members are going to be about this, I'm not sure I understand the class action concept here.

This is, unfortunatel, how RICO is often pled in class actions.
Replying to @AkivaMCohen
OK. RICO. And Ken, I'm sorry, but you have to specifically see this, which is the entirety of their RICO complaint @Popehat
No. Mr. Cohen is a putative class member. If a class is certified he will be a party as a class member.

1) Oh, hey, I'm a plaintiff
2) You think *season ticket holders* don't know the teams play in NJ?
Yeah. He’s wrong about diversity jurisdiction. But the plaintiff is not wrong about CAFA, which requires only minimal diversity (1 plaintiff different from 1 defendant).
Replying to @AkivaMCohen
I guess we can add diversity jurisdiction to the list of things this lawyer doesn't understand.
Who can spot the problem(s) here?
