Special Investigation Team Exposes False POCSO Case That Led to Father's Death
▪In Lohanda village under Saini police station of Kaushambi district, a dispute erupted on May 27, 2024, when a group of children threw stones while plucking kaitha (wood apple) from a tree. The stones landed on the roof of a nearby factory owned by Ram Babu Tiwari.
▪In reaction, Siddharth Tiwari, the son of the factory owner, slapped an 8-year-old girl involved in the incident. The child went home crying and informed her mother.
▪Angered by the incident, the girl’s mother went to confront the Tiwari family. In an effort to resolve the matter, Ram Babu Tiwari publicly beat his son Siddharth with slippers in front of the girl’s mother, after which she returned home silently.
▪Taking advantage of the situation, Sarpanch’s brother, Vipin Pal (who had a long-standing land dispute with the Tiwaris) manipulated the girl’s family into filing POCSO and Rape charges against Siddharth. Based on these allegations and without a proper investigation, the police arrested Siddharth and sent him to jail.
▪Ram Babu Tiwari ran from the police outpost to the main station trying to prove Siddharth’s innocence. When his pleas went unheard, he reached the police station on June 4 with a suicide note, expressing his anguish and stating that he would end his life if justice was not served.Despite this, the police ignored him.
▪It is alleged that Vipin Pal, the girl's father, and others forced him to consume poison inside the police station. Due to delayed medical treatment, Ram Babu died.
▪Following Ram Babu’s death, Siddharth, from jail, filed a murder case against Vipin Pal, the girl’s father, and 3 others. Vipin and the girl’s father were taken into custody.
▪During the proceedings, police conducted a medical examination of the girl and recorded her statement before a magistrate, along with 2 other children present during the incident. The girl confessed that she only repeated what her mother told her to say. The 2 boys denied any sexual assault and only mentioned the slapping incident.
▪A Special Investigation Team (SIT) was formed to investigate the allegations. The SIT uncovered that the rape case was fabricated out of personal enmity.
▪Based on the findings, police removed the charges under POCSO and rape, and prepared a new remand report. On this basis, Siddharth Tiwari was granted bail by the court on 09 June 2025.
