FALAS-GHANA through its research committee in this reflection undertake a comprehensive appraisal of the Electronic Transactions Act of Ghana. They trace the policy background and legislative process that produced the Act. Thy set out its stated objects, examines its scope and the categories of document and transaction that it excludes, and surveys the substantive content of its twelve constituent parts, from the recognition of electronic records and digital signatures to consumer protection, the licensing of certification and authentication services, the establishment of a Domain Name Registry and an Information Communication Technology Tribunal, and the creation of a suite of cyber offences. They consider how Ghanaian courts have applied the Act in practice, drawing on decided cases concerning the admissibility and evidential weight of electronic and digital material. Finally, they identifies a number of defects in the Act, ranging from definitional confusion between electronic and digital signatures, an underused certification and licensing regime, fragmentation across overlapping statutes, and the strain placed on the Act by technologies its drafters could not have anticipated. They propose reform.

Kwami Dorgbley Esq. reflects on the scale of fees for lawyers in Ghana. He argues that Ghana should adopt a single, binding national scale of professional legal fees for all practising lawyers, regardless of membership of the Ghana Bar Association or the Ghana Law Society. Upon an exposition of the legal framework for the scale of fees for lawyers, he distinguishes between a scale used to assess reasonable remuneration or recoverable litigation costs and a compulsory minimum governing private retainer. He argues for a carefully designed national instrument on fees with differentiated minima, lawful exemptions, transparent fee-setting, independent scrutiny, and proportionate enforcement.

Justice Alexander Osei Tutu of the Court of Appeal Bench argues, in this edition of his Friday Writings that Section 41(3)(c) of the the Matrimonial Causes Act, 1971 (Act 367) retaining barrenness as a ground for the dissolution
of customary marriages is constitutionally infirm, empirically unsupported, procedurally unfair, doctrinally inconsistent and internationally non-compliant. Justice Osei Tutu argues, that the said section violates Articles 17(2) & 26 (2) of the 1992 Constitution per Nartey v. Gati, breaches its own equity proviso, and denies audi alteram partem by allowing elders to declare a woman barren with no medical proof. It discriminates per se, as there is no equivalent ground for male infertility. Using Breast Cancer Awareness Month as a lens – the womb as the object – and drawing on Daniels, Fortes, Yankah, WHO data and the 2021 Census, he calls for reforms.
