This individual lives down on South America so I can't speak to how trademark and copyrights are handled outside of the United States. But I can tell you what little I do know about it here IN the United States. And the fact of the matter is this: admitting you know nothing about trademark and copyright law already demonstrates that you know more than what most people know on the subject. My mother worked as a paralegal for Jay Coggan who was a big-shot copyright attorney in Century City. His office was right above that big golf course that excluded Jews for so long. Jay Coggan got his start handling the copyrights and such for the Church of Scientology. If there's a boot camp for copyright and trademark laws, it would be handling that sort of thing for THOSE nutcases. While my mom was working there, Jay was handling Courtney Loves' side of the case against Nirvana when it came to who owned the music catalog. And you're probably thinking I'm leveraging my mother's employment at this law firm to impart my own expertise on the subject of trademark and copyright law and you'd be wrong. The only thing I learned being a fly on the wall the few times I got to be in earshot of those proceedings and conversations was just how hopelessly ignorant myself and everyone else is on this subject. I'm as clueless and ignorant on the subject as you are, but the only difference is I'm aware of my ignorance. There's a reason there's only a handful of major law firms that even bother with trademark and copyright in this country. And as far as I can tell given what dubious insight I've been granted, he who has more money in any copyright/trademark case will likely be the winner in the end. There are no clear-cut copyright and trademark laws, and none of them are friendly to the little guy like you and me. So you can argue about what's legal and what's illegal about drawing and selling fanart until the cows come home, but until the eye of Disney/WB/etc shines upon you personally and thus summoning their demonic legions of lawyers, then you don't have anything to worry about. Their checkbook is more the law in this legal scope than anything else these days.
