It will be on jurisdiction and perhaps on the merits.
The argument was a debacle for Trump and the DOJ lawyer who argued it.

Asked Ohio Dem gov nominee Amy Acton today about this answer from President Trump.
"The facts are: I was removed from custody from my mom. She was not well. From even a very young age, my brother and I experienced a lot of abuse and neglect, even before my stepfather. But my stepfather was not a good person, and it got worse then. He was indicted in a grand jury. He was a fugitive, and they left together."
"I have not seen her since I was 12 years old in a courthouse. So this is a sad story."
President Trump hasn't changed his stance on a controversial ad used by Ohio GOP gubernatorial nominee Vivek Ramaswamy featuring the mother of Democratic opponent Amy Acton, he told CBS News' @weijia on Friday.
Despite reporters bringing up Acton's mother stayed with her stepfather after being charged with raping Acton as a child, Trump continued to defend the ad.
"Her mother went on television and said that the daughter who is running for the governor of Ohio is a liar and a bad person, and that's all I know."

There is a massive corruption scandal unfolding in the US, with top American executives abandoning a $25 billion gas project over allegations of secret Russian investment and control.
All of this is happening just as the US administration moves to ease sanctions on Russia.
It is exactly what it looks like: blatant corruption. An attempt to sell out Ukraine in exchange for lucrative deals out of pure greed. Meanwhile, it is Ukraine that continues to endure constant, baseless accusations supported by nothing. Madness.

Votes are secret. The state has no idea of knowing who voted for whom, let alone why. What investigation could be carried out?
The Department of Justice does not seek to stop any ballot from being cast or to stop the certification of Alaska's election. This litigation seeks to ensure that after Alaskans cast their ballots, they are preserved in a manner so that only Alaska's governing officials have the information necessary to make a determination as to whether Alaskan voters were confused or mislead.
The lawsuit was written by Justice Department attorneys and the Department did not coordinate with any campaign or candidate, but rather relied solely on federal law.

OBAMA: He made a bunch of promises to get costs under control. I think we should examine how did these promises work out? Well, first of all, if you thought everything cost too much before… everything is more expensive now.
I want to be fair. As a former president, I can tell you sometimes factors beyond the president's control end up foiling the best laid plans.
That is not the case here.
This administration's actions are directly responsible for rising costs. The current president chose to make a series of bad decisions. Most importantly, he decided to start an unnecessary war that nobody asked for and nobody voted for
