🇬🇲🇬🇲: Melvin Roberts has argued that the Independent Electoral Commission cannot reject Mayor Talib Ahmed Bensouda’s presidential nomination under section 62(3)(c) of the 1997 Constitution. That provision disqualifies a person who, while holding public office, has been found liable for misconduct, negligence, corruption or improper behaviour by a commission or committee of inquiry. Roberts maintains that the Local Government Commission of Inquiry made adverse findings against Bensouda but did not conclude that he was liable for those grounds in the sense required by the section.
He notes that the Commission recommended a review of Bensouda’s fitness for public office rather than determining that he was unfit, and that it distinguished between adverse findings and a final attribution of personal liability. According to Roberts, the Commission itself indicated that final personal liability requires notice, an opportunity to respond, verification of records and proper attribution of responsibility, and that only a court of law can ultimately decide liability. He has therefore urged the IEC to examine the Commission’s actual recommendations carefully before determining eligibility.
