Lots of misunderstanding here. An appeal from a jury verdict in our system is not a re-trial. The last thing the appeal judges would do is substitute their opinion of the evidence for the jury’s. The verdicts have to be shown to be unsafe & unsatisfactory due to eg:
• a biased or erroneous summing up
• prejudice arising from pre-trial reporting or trial coverage
• new evidence not available during the trial
and so on.
I should say the chances on appeal in this one would be pretty grim, given that pretty much the whole case turned on the jury’s assessment of the oral evidence.
I don’t like suggesting this but I have a feeling that the Brand verdict may be overturned on appeal. The charges are very difficult to prove conclusively. The Defence counsel (not a charmer!) did make a reasonably credible case.
The Jury rejected it for four of the charges but not for two where Brand was Not Guilty. This suggests that the extent of his illegal behaviour is at the very least disputed under the law.
It’s worth reading Winter KC’s closing address to the Jury which is well argued. We may dismiss it as clever advocacy and highly selective but that happens in adversarial argument. He’s a very experienced and successful barrister !
Finally, as ever, consider if there is “reasonable doubt” . An appeal court may well find that there is.

What Yatseniuk is asking for is to end the war, so that:
- the US and Europe should invest billions in Ukraine on a non-repayment basis (a new Marshall plan);
- allow the Ukraine full access to the EU which will bankrupt Europe;
- pay for Ukraine to keep an army of one million which the country doesn't have the money for because it is already bankrupt, in order that;
- Ukraine can go to war with Russia again in the future to regain territory which it will never get back;
- but which it might have kept within Ukraine had ANY Ukrainian leader after 2014 committed to a peace process, including Minsk 2.
Victoria's Nuland's puppet is no less delusional today than he was in 2014 when he was given the job of Prime Minister despite not obviously being equipped for the job.

Viktor En, the ambulance driver who arrived with Valentina Molodaya at the Azov house in Petropavlovskaya Borshchagovka near Kiev, has been ordered held in custody without bail.
Investigators allege he filmed the house, which they describe as a military site.
Molodaya and Tatyana Kireyeva, who tried to get a detained soldier released and taken to hospital, are already in custody on the same terms.

THE INSPECTOR WHO INSPECTED TOO HONESTLY
Dr Shyam Kumar @ukorthopod is an orthopaedic surgeon. A good one. Unblemished record. So the Care Quality Commission (@CareQualityComm) recruited him as a part-time inspector to help hold NHS hospitals to account.
He took the job seriously. Too seriously, it turns out.
Between 2015 and 2019 he raised concerns about botched hospital inspections, a bullying culture inside the CQC itself, and a surgeon at Morecambe Bay whose hip replacement on an elderly patient left her unable to walk.
He asked the CQC to review that surgeon's cases. He was told the trust did not want to do so for reputational reasons.
A Royal College of Surgeons review later found problems with 26 out of 46 of that surgeon's operations.
The CQC's response to Kumar? They called his concerns fanciful. They dug for dirt on him. Then they sacked him.
In September 2022 a Manchester Employment Tribunal ruled he had been unfairly dismissed.
The tribunal found his safety disclosures had directly influenced the decision to get rid of him. The judgment noted that CQC officials spent their energy gunning him down rather than focusing on patient safety.
He was awarded £23,000 for injury to feelings.
Not damages for a ruined career. Not accountability for the officials who ran the smear operation. Just £23,000 and a declaration.
The CQC issued a statement saying it had learnt from the case and improved its processes. A decade earlier it said exactly the same thing after the Mid Staffordshire Public Inquiry found it had victimised its own whistleblowers then too.
The system that was built to protect patients ran a seven-year campaign against the man raising the alarm.
Then it said sorry and carried on.
