ALT Can I protest under current coronavirus regulations? Yes. As of 19 July 2021, there are no Coronavirus-related restrictions on gatherings. Protest is a fundamental right protected by the Human Rights Act and can only be lawfully infringed where it is a proportionate means of achieving certain aims. Can police arrest me? The police can impose conditions on protests where they reasonably believe that the protest will result in “serious public disorder, serious damage to property or serious disruption to the life of the community”, or that the purpose of the protest is “intimidation of others”. Failure to comply with any directions relating to these conditions may result in arrest. However, the police should first give you the opportunity to comply. Do I have to answer police questions? If you’re stopped by police, normally you don’t have to tell them your name, what you’re doing or where you’re going. You can’t be searched or arrested just because you refuse to answer their questions.

ALT If you are arrested Before arrest, police should explain that you’re being arrested, what offence you’re being arrested for, and why. If you’re arrested, say “NO COMMENT” to all questions, including ‘chats’ from the police until you have free advice from a specialist solicitor. Don’t accept a caution without advice.
