CVS states in recent court filing: “CVS Defendants are not fiduciaries under plan sponsors’ contracts as a matter of indisputable fact.” So ESI says it’s not “contractually obligated” to control costs & CVS says it isn’t a fiduciary. What, then, do they do for plan sponsors?
