ANNOUNCEMENT 📢 SPRIBE OÜ secures Provisional Injunction for Aviator IP rights in All EU Territories SPRIBE has obtained an urgent provisional ex parte court decision ordering Aviator Studios to cease infringing its Aviator EU trademarks, securing another step towards its intellectual property protection across the entire European Union The decision, handed down by the First Hall of the Civil Court in Malta, targets three entities: Aviator Studio Limited, Aviator Studio Holding Limited, and Aviator Studio USA Limited In line with the decision: • Aviator Studios must cease all use of identical or confusingly similar marks and immediately cease its use of aviator.studio or/and other websites that includes signs infringing of SPRIBE’s EUTMs in relation to identical or similar goods or services • The injunction was issued on the basis of SPRIBE’s EU trademark numbers 018817594 and 018825078, which safeguard SPRIBE’s original logo, plane graphic, and signature audiovisual part of the iconic Aviator game • The breach of this provisional order may trigger severe penalties In its application to the Court, SPRIBE demonstrated that Aviator Studios had sought to promote and commercialise their ‘imitation’ version of the Aviator game, in a way that is likely to mislead and confuse players, operators, and commercial partners
