For offences punishable with less than 7 years’ imprisonment, arrest is not supposed to be the first step. The police are required to issue a notice of appearance under Section 41A CrPC where applicable. So don’t walk into a police station just because someone says, “Come over for a few questions.” Always ask the officer to issue a written Notice of Appearance instead of relying on a phone call. Know your rights before you enter the police station.
