Some further thoughts on the NYT bombshell re: SCOTUS. First. we need to get serious on ethics. The Supreme Court Ethics, Recusal, and Transparency Act would be an excellent place to start. Among other things, it requires the adoption of a code of conduct. nytimes.com/2022/11/19/us/su…
There's a 1971 court case where an airline tried to defend its practice of hiring only female flight attendants because, they claimed, consumers preferred it. (Diaz v. Pan Am. World Airways.) That defense was decisively shot down by the conservative 5th Circuit, 50 YEARS AGO!
This clip doesn’t even need a caption. “Has UMN Morris become too diverse for a student to attend?” How is this an actual question being asked during a Board of Regents meeting??? @BSU_UMN @USGumn @mndailynews @StarTribune @Ilhan @kare11 @alphanews @KSTP @FOX9 @RWPUSA #UMNProud

This is quite a statement from Judge Jed Rakoff about the current Supreme Court in his review of the new Justice Frankfurter biography:

So, @TheOnion filed an amicus brief before the Supreme Court in defense of parody under the First Amendment… and it’s exactly what you’d expect. supremecourt.gov/DocketPDF/2…

In his dissent, Justice Alito calls a law forbidding LGBTQ+ discrimination “a state imposition of its own mandatory interpretation of scripture.” That’s a pretty shocking picture of antidiscrimination law—aimed to impose some kind of state religion, rather than promote equality.
As we continue to fight to achieve justice for Mary Kay Thomas, a longtime principal in Marshall, Minnesota, we're glad to be reminded that her actions inspired so many to find their voices.

SO POST-1964 HOW WERE COURTS TO DETERMINE IF AN EMPLOYMENT DECISION WAS DISCRIMINATORY? SOLUTION: THE "MCDONNELL DOUGLAS" TEST. BUT IN THE DECADES SINCE COURTS HAVE MADE IT SO HARD FOR VICTIMS TO SATISFY IT THAT IT ACTUALLY OPERATES AS A MAJOR BARRIER TO EQUALITY IN THE WORKPLACE

If you have been craving a huge victory for abortion rights, you have come to the right place. 🧵
“We know our case will ultimately move forward to the merits,” said Jess Braverman, legal director for Gender Justice. “The question now is when.” An update on #DoevMN, our lawsuit challenging state abortion restrictions: thetelegraph.com/news/articl…

Today is day 185 of the year, and the U.S. has already experienced at least 309 mass shootings so far. At least 309 in just over 26 weeks. This averages out to more than 11 a week. n.pr/3yFYfiZ

As Leah notes, the conservative majority in Kennedy overrules #SCOTUS's major prior Establishment Clause precedent in Lemon, but tries to pretend that the Court had *already* overruled it in prior cases (spoiler alert: it hadn't). This is sketchy *even if* you think it's correct.
first, but not last, #SCOTUS opinion is Kennedy v. Bremerton schools --> Justice Gorsuch writes for 6 that school can't discipline a coach for engaging in public prayer at public school football game. #SCOTUS says it has "abandoned" the Lemon test???

No actual beans. If all goes perfectly they will someday grow into beans. But a lot could happen between now and then. If someone dug them up right now—at just 6 weeks—no actual beans would be harmed.
