BREAKING: SCOTUS denies the Trump administration's emergency bid to pause a court order that blocked the Federal Bureau of Prisons from enforcing a policy that halts gender-affirming care for transgender female inmates.
The order is unsigned and without explanation, but there is a note that both Justices Thomas and Alito would have granted the stay.
NEW w/ @CarolLeonnig - Lawyers for David Hearn tell MS NOW the DOJ’s watchdog is declining to investigate the events surrounding the former Olympian’s failed prosecution, but a probe by the Interior IG remains under review

“I am not the Lorax. I do not speak for the trees. I am a judge,” U.S. District Judge Ana Reyes said at a hearing last month.
She said she wasn’t the Lorax, but she’s kind of acting like him.
Here’s an explanation on what Reyes wants to know and why she was so angry as the tree chopping issue returns to court this morning.

NEW: Judge Jia Cobb has dismissed John Brennan's bid to obtain a court order mandating the Trump administration to preserve all records related to its investigations of him.
She found that without a proseuction, his claims were speculative.
Brennan responded to the dismissal, telling MS NOW: "With this lawsuit, Director Brennan has served notice that the government’s conduct and its document preservation will be carefully scrutinized in the event of any future indictment. Director Brennan will continue to vigorously defend himself against these baseless investigations, and he will challenge any attempt to use the criminal justice system for personal and political retribution."
h/t @JesseRodriguez
John Brennan had sought all records related to these investigations in order to prepare a defense should he face prosecution in the future.
U.S. District Judge Jia Cobb dismissed Brennan’s lawsuit, finding his claims, although “troubling,” to be speculative at this point in time.

NOW: Ted Boutrous is on MS NOW for his first television interview since Judge Kelly indefinitely reversed Trump's ban on MS NOW, CNN and Politico.
Boutrous says Trump's repeated public statements about the ban undercut the arguments the government was making in the courtroom.
"He just really undercut them completely."
The Trump admin has already appealed Kelly's preliminary injunction. Asked about the chain of appeals, Boutrous responds, "We're ready for them to try to go to the Supreme Court."

JUST IN: As expected, the DC golf course plaintiffs have filed a motion for a preliminary injunction, asking Judge Reyes for a longer-term block on any tree removal, as well as an order requiring three days' notice before the Trump administration makes any "irreparable modification to any permanent features of landforms of East Potomac Park."
Reyes is set to hear arguments on this motion on Monday.
NEW: The White House has responded to Judge Kelly's ruling that indefinitely reversed Trump's ban on MS NOW, CNN, and Politico. They are vowing to appeal.
A spokesperson tells MS NOW: “The Fake News has no place demanding a spot in the President’s Oval Office. The lies they smear are a disservice to the American public and tear at the very fabric of our Democracy. They’re completely capable of reporting from directly outside. We intend to appeal this misguided decision.”
