🚨 NEW: Andrew & Tristan Tate File 67-Page Federal Habeas Petition Challenging Their Continued Detention
Andrew and Tristan Tate have filed a 67-page Petition for Writ of Habeas Corpus in the Southern District of Florida challenging their continued detention while they fight the UK extradition request.
This is not the extradition hearing itself, and it is not a lawsuit seeking damages against Marco Rubio. The petition challenges the legality of keeping the brothers incarcerated while the extradition proceedings are pending. Rubio is named as a respondent because of the Secretary of State’s role in the extradition process.
🔹 THE CENTRAL ARGUMENT: BAIL
The defense is directly challenging the way the court has applied the “special circumstances” standard from the 1903 Supreme Court case Wright v. Henkel.
McBride argues that Wright should NOT be interpreted to mean that an extraditee must first prove some extraordinary circumstance before being considered for release.
Instead, the defense argues that “special circumstances” should mean circumstances that reasonably assure the extradition court that the person will not flee or pose a danger to the community.
Their position is essentially:
If strict conditions can reasonably guarantee an extraditee’s appearance, incarceration should not automatically be required.
The petition specifically points to measures such as electronic monitoring, hired security, and other restrictive conditions that could ensure Andrew and Tristan remain available to the court.
The defense also argues that, because extradition proceedings are criminal in nature, the presumption should favor bail, with the government bearing the burden of establishing that detention is necessary because the extraditee presents a flight risk or danger to the community.
🔹 WHY THEY BELIEVE THEIR HISTORY MATTERS
The petition puts substantial emphasis on what happened in Romania.
Andrew and Tristan were arrested there in December 2022 and subsequently released under Romanian judicial conditions.
The defense says they remained under those conditions for years and complied with Romanian authorities.
On February 25, 2025, their Romanian travel restrictions were lifted.
Since then, according to the petition, they traveled extensively—including to the United States, UAE/Dubai, Croatia, the Bahamas, Turkey, Kazakhstan, Oman, Hong Kong, Uzbekistan, Russia, and Cyprus—and repeatedly returned to Bucharest to comply with their Romanian obligations.
The defense is using this as evidence that they have already demonstrated an ability to travel internationally without simply disappearing from Romanian proceedings.
🔹 THE UK HAD ALREADY OBTAINED A ROMANIAN SURRENDER ORDER
Another major point in the petition is that the UK had already initiated extradition proceedings against the Tates in Romania in March 2024.
According to the petition, the Romanian court agreed to surrender them to the UK after the Romanian criminal proceedings concluded.
The defense argues that the UK therefore had an existing route toward their eventual surrender, yet the brothers remained subject to Romanian proceedings and continued complying with the conditions imposed on them.
🔹 WHAT HAPPENED IN THE U.S.
The petition lays out the timeline:
July 18, 2026:
The Tates were arrested in Miami on provisional UK extradition warrants.
August 7:
They filed their motion seeking release pending extradition.
August 27:
The detention/bail hearing took place.
The defense argued that several circumstances justified release, including:
• The Romanian surrender orders
• The delay in the prosecution
• The availability of bail in the UK
• The lack of urgency
• Their public visibility
• Their history of compliance with Romanian conditions
• The defense’s challenge to probable cause
• Their conditions and length of confinement in the FDC Miami SHU
• Their pending Romanian and Palm Beach proceedings

⚖️ A ruling that the Tate brothers are extraditable in November does NOT mean they’ll be immediately sent to the UK. There are still several legal steps ahead.
The habeas corpus they’ve already filed focuses on their detention and their request for release. It does not automatically challenge a future extradition certification.
If the judge certifies them as extraditable, their lawyers would challenge that decision through habeas corpus. They may need to file a new petition or seek to amend the existing one, depending on the court’s decision. If that challenge fails, an appeal may be possible.
Only after the judicial process is exhausted does the final surrender decision go to Secretary of State Marco Rubio.
The point is, there are several stages between the November hearing and any actual surrender. The case has been moving quickly, but a ruling that they’re extraditable is not the same as being handed over to the UK. There is still a legal process to get through before that can happen or even land on Rubio’s Desk.

⚖️ ⭐️THE TATES FACE A DIFFICULT CHOICE: MORE TIME TO PREPARE — OR MORE TIME IN CUSTODY?
The August 27 bail hearing transcript raises a serious fairness concern about the practical consequences of the UK extradition process.
On page 55, the Tates’ UK solicitor explains that the brothers do not yet know the identities of the people involved and that the preparation period may be limited to approximately 181 or 182 days. The solicitor questions whether that period would be sufficient to investigate the allegations, obtain relevant evidence and become fully prepared for trial.
The central issue is the relationship between preparation time and continued detention. The brothers may need additional time to prepare their defense, but any extension or delay could also result in them remaining in custody for longer. Conversely, if additional time is not granted, they may be required to proceed without a meaningful opportunity to identify the allegations, examine the evidence or prepare their case properly.
This places them in a difficult position: accept a potentially inadequate preparation period or request more time while facing the possibility of continued detention.
The transcript does not establish that an abuse of process has occurred. It does, however, demonstrate why the relationship between the preparation timetable, procedural delays and continued custody deserves careful examination.
Whether this concern would be legally decisive would depend on the applicable extradition rules, the reasons for any delay, the court’s assessment of the evidence and the safeguards available to protect both the defendants’ rights and the integrity of the proceedings.
No person should be required to defend themselves without a reasonable opportunity to understand the allegations, investigate the evidence and prepare for trial.
Read pages 54–55 of the August 27 bail hearing / extradition packet.

⚖️ THE POLITICAL DIMENSION OF THE TATE CASE IS RIGHT THERE IN THE TESTIMONY.
When asked whether there had been calls for Andrew and Tristan Tate’s extradition among political circles in the UK, the witness answered: “Many.”
The witness then described it as “abnormal” for MPs to comment on live criminal investigations, referencing statements in mainstream media and the House of Commons.
The testimony also characterizes the circumstances surrounding Romania’s decision to grant extradition as “unprecedented.”
This is bigger than a legal dispute. Political circles, members of Parliament and mainstream media are all part of the picture described in this testimony.

So this quack kindly admits its a degenerate. 💥 a low vibrational squirm hole.
you were born that way, right? all I do is react- but you’re literally born that way.
certainly- that’s why gadget is a bed weather who’s avoiding to get sued and team matrix are literally in court documents exposed for going to certain heights not to get exposed
Go fuck that.

3 long fucking years of you promoting off based degenerate shit. I am surprised you stopped selling it.
Wack job. I am also surprised how you people are “Anti MAP” but also create these accounts and lower the ages of alleged victims. @TheZombyPop - I see you bro.
What’s up. @FBI
These people behave like they didn’t receive the 1st message.
Didn’t these off-based people post naked pictures of an alleged minor?
sorry pax wax : 🚨there are still no charge for anyone being 14 years old or 13 or 12 - I know you were really hoping for that.
At this point, you have to be an illiterate to not understand and read close to over 100 pages that clearly states the person was 17.
And: I have clarified that is against the law to put a minor under 18 on cam. but not against the law to have a relationship with.
Like I mentioned, you were the only one that posted pictures, made references that the person was under the age of consent - stark nude on a social media platform.
how slow do you have to be to not understand that if the person was under the age of legal consent in that country there would’ve been laws reflecting that within the charges.
She was the age of consent but “a minor” to be put on Web.
I am so sorry that those other storyline fictitious sicko shit didn’t work out for you guys.
how are you people involved with against MAP campaign - but still post nefarious underage suggestions and make sick accounts.
-@TheZombyPop Are you the Pooholes account? And don’t even go there.
The ALT accounts you create have your design style and artwork all over them. The MAP obsession, the bizarre content, the same distinctive signature. You create these accounts, then try to pass them off as if they belong to other people. But the patterns are unmistakable.
Nobody spends that much time obsessing over incest, cock, assholes, and degenerate shit unless they’re deeply invested in that world. We see what you’re doing.
Gem is a male. He’s not your account, but he knows your ALT accounts.
Sorry I had to break it down for you like this. Don’t mistake people not calling you out -for people not noticing you’re a nonce.
“Hey Vendetta, weird ending to the pdf story. These accounts, all operated by 1 user. This user likely is the culprit of fake crayons accounts / Team Matrix accounts. This account behind them is @Alfie_Samuelson, who is linked to a name: Sergej Suvorov. Going back to 2023, under Alfie related pseudonyms, he was posting pro Tate supporting content but was pressed by accounts accusing him of defending pdfs. In 2024 he nuked his own account because it was full of defending sex with minors & defended Jimmy Savile as innocent without a conviction.
*He makes a new account @Alfie_Samuelson to recreate his image. *He simultaneously creates a new Pro Tate account @SashaRibobshkiy which he operates to continue the conduct of his former account. This is one demented guy operating two accounts that argue with eachother all day for years to paint the illusion. The earliest handle for @SashaRibobshkiy was in fact an Alfie alias.
* The Datwood/Natwood/Hatwood accounts he uses to call everyone a pedophile, is to confirm his own leanings, and popularise them into acceptance. The theme of 'wood' relates to arguments with an account user 'Anthony Norwood' who got his GF pregnant when she was 16. An account which he creates several sockpuppet accounts to mock and use to draw out 'confirmation' bait from Tate Supporters.
*This guy is not well, obviously socially reclusive and on the spectrum & has no life. I basically used Grok to decode all his accounts, and found accounts that logged his entire backstory in real time. The vernacular, and nature of his disturbed behaviour is all consistent. Imposter accounts are highly likely to be this user
The accounts @BhoyBass & @_shikari__ were exposing the account @Alfie_Samuelson. In August 2024, the new account resurfaces with same handle. It bans @BhoyBass & @_shikari__, but a new account @Bob_McHassy is created not long after, which is an anagram of @BhoyBass. The account handle was then changed to @SashaRibobshkiy, which is an anagram of both users accusing @Alfie_Samuelson of being a pdf. Bob McHassy is created with bio: 'favorite film: 'Black Swan', which is code for creating TWO distinct personas, where the white swan personifies an alter ego dark persona. Profile bios are aimed at taunting @Bhoybass. Tho You can see odd handle changes in mid conversation, and when searching the handle, Sasha's new account showed up..
The accounts interplay now takes the form of Alfie as being reformed good guy, but now the Sasha takes on the form of the old Alfie accounts. The accounts are immediately hostile to each other, with new Alfie account taking on the form of its own accusers.”

A-lot of work went into this and I appreciate this person for allowing me to share this. 💪

The Transcript from the Bond Hearing On August 27,2026
⚖️Romania and the Alleged Victims” { Small excerpt}
“On September 5, 2024, the Court of Appeal
rejected DIICOT -- they are a special investigative authority --
DIICOT's appeal and removed Andrew's communication restriction with one of the alleged victims*. So these gentlemen were allowed to communicate with the alleged victims in the file, legally, under Romanian law, after the finding by the appeals court.”

Let’s nor forget: Two more “victims” testified for Tate in the extradition case. And, there’s also the “two more” who sued Jane Doe.

The DOJ just keeps reciting the law. This is not a response but a filler. Than had the academic audacity to ask for 50 pages of more law lingo filler.
This is not a response people - even the retards know this. Its a regurgitation of the law; Laws that a DISTRICT Court knows by heart. Read this shit 👇
Do not spend hours reciting the law- The Judge
DOJ: OK, I’ll recite every law available.
These people never needed the 50 pages. They just didn’t know how to answer and that’s the main reason why they asked for an extension.
⚖️ Judge Melissa Damian was clear about what she wanted from the DOJ.
She did NOT ask for a breakdown of the law surrounding special circumstances or pages and pages of other court cases explaining the law. She wanted a direct response to the issue before her.
And yet, that is EXACTLY what the DOJ handed her.
More than half of the response focuses on the law surrounding special circumstances and other court cases to support 1903 Wright.
This is specifically what the judge instructed them NOT to do.
While the haters are celebrating that the DOJ responded, they’re overlooking two important details:
The DOJ already needed an extension, and what they ultimately submitted was pages and pages of legal arguments and case breakdowns that the judge specifically wanted them to avoid.
In hindsight, they could’ve submitted 12 pages directly addressing what the judge actually asked for.
My grade: C+ Pages and pages of court case fillers. Specifically told them not to do it.

🚨 BREAKING | PAGE 27 OF THE DOJ HABEAS CORPUS TRANSCRIPT
The Tates’ ability to properly prepare their defense for trial while detained raises serious questions.
How can a fair trial proceed if the defense cannot adequately prepare?
‼️What was stated:
⚠️“They have yet to be able to contact the Romanian counsel in any meaningful way. He
cannot travel to the United States to see them. And, their case is -- the investigation in their case is still ongoing there in Romania.”
—
1- This is the thing: not only is this detention making it impossible for the Tates to defend themselves—even at the initial stages—there is a threat that they will be unable to do so moving forward. I will remind you that the indictment in Romania is wrapping up its preliminary review.
2- If you have been paying attention to the civil cases in Florida, there have been several delays on the Tates’ side, possibly due to their detention.
-
This is illegal.Or better YET - Legally a very serious due-process and fair-trial concern.
