Americans deserve to have confidence in their elections. The courts have made it clear that the preferred remedy for election law violations is criminal prosecution. Building on Operation Protect the Vote, we will continue investigating and charging those who violate election laws or assist in their violation.

Specifically, in cases where the United States is not a party, as here, the Department’s Touhy regulations prohibit current and former employees from disclosing “any material contained in the files of the Department” and “any information relating to or based upon material contained in the files of the Department,” without prior approval from the proper Department officials. 28 C.F.R. § 16.22(a). Section 16.22(c) additionally requires that a Touhy demand for testimony include “a summary of the testimony sought and its relevance to the proceeding.”
