Congress’s central failure is that it claims to oppose the RSS while increasingly borrowing its language, logic and political methods. This is not merely a contradiction; it is an indictment of a party that invokes the Constitution while tolerating arguments that undermine its most basic protections. As a Muslim, I have no obligation to prove my patriotism by accepting collective blame, endorsing incarceration without due process or remaining silent when an entire community is demonised in the name of national security. Calling someone a terrorist sympathiser does not make it true. Equating #SharjeelImam a political activist with Hafiz Saeed or Ayman al-Zawahiri is not a serious argument; it is character assassination. Declaring that keeping people in prison without constitutional and legal safeguards is a “necessary evil,” amounts to an outright rejection of the rule of law. Most disturbing is the demand that Congress, once in power, should ensure that particular individuals remain imprisoned regardless of constitutional protections. That is not justice. It is political vendetta disguised as national security. The RSS has spent decades normalising the idea that Muslims must constantly prove their loyalty to India and that extraordinary measures are justified when Muslims are the targets. When Congress leaders adopt the same logic, reproduce the same collective suspicion and demand the same suspension of civil liberties, what meaningful ideological difference remains? This is the indictment of Congress: it has failed to offer a principled alternative to the politics of the RSS. Instead of defending equal citizenship, it too often mirrors the very prejudices it claims to oppose. A party cannot credibly claim to defend the Constitution while celebrating its circumvention. Gandhi’s name cannot sanitise authoritarianism, and invoking Dharma cannot transform injustice into justice. Muslims do not need to be patronised by Congress, nor do they need symbolic appeasement. They need a party that defends equal citizenship, constitutional freedoms and the rule of law without calculating whose rights are politically convenient to protect. If Congress wants to defeat the RSS, it must first stop becoming its political and ideological imitation. The muslims within congress need to respond to this diatribe by one of their esteemed colleagues. The Indian Constitution promises equality and religious freedom. But a closer look reveals a troubling contradiction: the rights it guarantees are not always experienced equally. Article 44 pushes for a Uniform Civil Code that could override Muslim personal laws. Article 48 gives constitutional backing to cow protection, with consequences for Muslim livelihoods, dietary practices, and the cattle trade and has led to several lynchings of innocent muslims. Article 341, read with the 1950 Presidential Order, denies Dalit Muslims Scheduled Caste status, even when caste-based discrimination continues after conversion. Article 25 guarantees freedom of religion, but subjects it to “public order, morality and health.” It also allows the state to regulate religious practices in the name of social welfare and reform. Article 26 offers similar protections to religious denominations, but those rights are also qualified. This raises a fundamental question: Who decides when religious freedom becomes a threat to public order, and whose religious practices are subjected to greater scrutiny? It is often he hindus and liberals who decide how to restrict the religious freedom or muslims The Constitution may not explicitly declare Muslims second-class citizens. But constitutional provisions, selective enforcement, and unequal outcomes can create a reality in which minority rights are protected in principle while being restricted in practice. A constitutional democracy cannot claim meaningful equality merely because discrimination is absent from the wording of its laws or concealed very well so as to not appear explicit. The real test of secularism is not how loudly a Constitution promises religious freedom, but whether that freedom is protected equally, even when the religion is a minority’s.
