With all the division over the Lindsay Clancy case, it is interesting that there hasn’t been much discussion over what appears to be a key cause of what will surely be a hung jury…
There seems to be a burden of proof problem. People seem to think that it is the prosecution’s burden to prove beyond a reasonable doubt that she was NOT insane. This is absurd. In a case where physical guilt is not in question, the insanity defense clearly needs to put that burden on the defense to prove that she WAS insane. Otherwise, why wouldn’t every murder defendant claim insanity?!

1. Speaking basic English is a general requirement to become a U.S. citizen.
2. Only U.S. citizens can vote.
So why are ballots printed with multiple languages?
If you cannot even read the constitution, let alone understand it, YOU HAVE NO BUSINESS VOTING.
