$DTREF $DTR I watched the full Zoom hearing live today (10 am PT) before Judge Snyder on the Colosseum stay motions. Dateline counsel Strub and DOJ counsel Laubach were both very sharp. A tentative ruling denying the stay went out Saturday. DOJ argued that new national security concerns that have since arisen mean the Court should reverse course and grant the stay. Dateline’s lawyer then dropped a nice curveball: he asked the Court to require NPCA to post a bond to cover harm to the company from the injunction, and rattled off a string of precedents. It was impressive. NPCA’s lawyer looked agitated and flustered -he was clearly hoping for a ruling in their favor today. Judge Snyder said that because of the new national security issues she will go back and think about it and issue a ruling relatively quickly. She did seem skeptical about the rare earths at the Colosseum, which is odd because her injunction doesn't allow them to prove it, meaning we would never be able to find out for sure, and with it being national security it's not a good look IMO. Also, the foremost rare earth expert in the world, and the govt agencies are all on board, she is effectively saying her opinion is better than these experts!? This comes literally hours after a federal judge ruled that Coney’s daughter was illegally fired, and that the government owes her backpay.
The case concerns an alleged 2016 leak to a reporter and has been assigned to Judge McFadden.

⚖️ $DTREF $DTR HERE is my closing argument for the OCT 26 Hearing: The 1985 BLM approved Plan of Operations at Colosseum predates the 1994 California Desert Protection Act by nearly a decade. That approved plan is not a claim that vanished when the Mojave National Preserve was created. Under the Act’s explicit savings clause, it is a protected “valid existing right.” Senator Dianne Feinstein, the primary sponsor of the Desert Protection Act, said so on the Senate floor: all valid existing mining claims are protected, all active mines are protected, and all mines that have been approved to proceed will be able to do so. The plaintiffs ask the Court to ignore that text and that history. A preliminary injunction that freezes a project resting on recognized preexisting rights does not merely prevent speculative harm. It creates its own irreparable harm to Dateline’s ongoing operations and to the public interest in domestic critical mineral supply. US energy company execs have resigned in disgust as the Trump family is caught secretly expediting the funneling of $25 billion from a sanctioned Russian energy giant in exchange for allowing Russians to obtain a natural gas project in Alaska.
According to investigations by The New York Times and Financial Times, Russia's Novatek allegedly concealed its financial involvement in the American project through a UAE-linked intermediary.
Gentry Beach, a longtime Trump ally and close friend of Donald Trump Jr., signed an agreement with Novatek to pursue natural gas development in Alaska. Reuters documented the arrangement in February.
Meanwhile, Vladimir Putin discussed this cooperation on the Alaska energy project with Trump's representatives, Steve Witkoff and Jared Kushner, during negotiations involving Russia and Ukraine.
The controversy deepened when Polar Train LNG's CEO, Joel Riddle, raised concerns about concealed Russian financing and possible sanctions violations. He departed in September, followed by other senior executives.
The Financial Times also described discussions about a potential arrangement under which Novatek would provide technology for the Alaska project in exchange for sanctions relief benefiting its Arctic LNG 2 development in Siberia.
According to The New York Times, Riddle and two other departing executives warned the Trump administration about the Russian financing and urged officials to investigate.

‘The reality is that they were both in it,’ a senior source said of Musk’s and Trump’s involvement.
But after a night of carnage in Kyiv caused by the slowdown, Musk was alarmed about the possibility of adverse consumer reaction in Europe.
The SpaceX boss then proceeded to tweet, blaming the US administration, and ultimately, President Trump for authorising the slowdown.
