𝗖𝗼𝗺𝗺𝘂𝗻𝗶𝘁𝘆 𝗚𝗿𝗼𝘂𝗽𝘀 𝗥𝗲𝗴𝗶𝘀𝘁𝗿𝗮𝘁𝗶𝗼𝗻 𝗔𝗰𝘁, 2022 𝗗𝗲𝗰𝗹𝗮𝗿𝗲𝗱 𝗨𝗻𝗰𝗼𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝗮𝗹 Defenders Coalition welcomes the High Court of Kenya’s decision, declaring the Community Groups Registration Act, 2022 unconstitutional. Justice Lawrence Mugambi, in his decision found that public participation preceding the enactment of the legislation was not adequately conducted, thus being unconstitutional. The Court has directed that Parliament within the next six months remedy this, failure to which, the Act will be declared fully unconstitutional. This decision is welcome, noting the impact it has on human rights defenders who work through community groups to champion for human rights and freedoms within their communities. We urge Parliament to adhere to the Court’s directive and ensure that effective public participation is actualised and the voices of those who will greatly be impacted by this law, are heard and their views taken into consideration.
