Vesting executive magisterial powers in police officers raises questions of institutional independence, procedural fairness & accountability. Separation of law enforcement from preventive executive decision-making merits serious consideration where liberty is at stake.
When Police Act As Magistrate : The Bizarre Case Of Special Executive Magistrates |@manuvichar
If the roles of investigator, prosecutor, and adjudicator are blended in a single agency, can the process be considered fair, independent, and reasonable?

That is precisely my point. Let police officers exercise the powers of Special Executive Magistrates when it comes to maintaining public order and dispersing unlawful assemblies. However, when it comes to exercising quasi-judicial functions, such as proceedings under the erstwhile Section 107 CrPC, should these powers not be entrusted to officers of the IAS and DANICS instead?
After all, does Article 50 of the Constitution of India not expressly mandate the separation of the judiciary from the executive as one of the Directive Principles of State Policy?
Can a police officer take office uniform and don the robes of a judge, a special executive magistrate??

Hon’ble SC stay on Hon’ble Allahabad HC verdict is a reminder that accountability must go hand in hand with due process. Officers discharging statutory duties deserve a fair examination of the entire decision-making process before personal liability is imposed.
Satyameva Jayate!
Taken serious note of the personal imposition of a ₹5 lakh penalty upon the DM Gautam Buddh Nagar (Noida), for an exercise of statutory preventive powers.
Officers exercising statutory powers in good faith must not be made personally liable. Police accountability and administrative accountability must coexist with institutional protection for officers acting bona fide under law.

Personal attacks & online vilification directed at DC/DM Kishtwar are deeply unfortunate. Civil servants must be open to scrutiny & criticism, but coordinated abuse, intimidation, or attempts to malign an officer before the facts are established have no place in any society.
We appeal to all stakeholders, including veterans, media, & citizens, to allow due process to take its course & engage in responsible, respectful public discourse. Institutions are strengthened by facts, fairness, & mutual respect—not by social media trials.

1. Vehicle ferrying guests of Cdr RR Sector, including child, thus not ops. Why guests in ops area?
2. DC convoy with distt officers on way to public darbar, thus official
3. Vehicle refused way to convoy
4. Guests of VIP RR officer, explains extreme reaction by 17 RR on police
The reported incident involving the district civil administration and army officials in Kishtwar is deeply concerning. DC must be able to discharge their lawful duties with dignity, authority, and without intimidation.
At the same time, the Indian Army remains one of our nation’s most respected institutions, and any misunderstanding between agencies working towards the same objective must be addressed through established institutional mechanisms.
