Constitutional and Administrative Framework: “Provisional Province of Jammu & Kashmir”
1. Fundamental Status and Administrative Structure
• Official name: Provisional Province of Jammu & Kashmir
• Governor (nominated by the President of Pakistan)
• Chief Minister (elected by majority in the Provisional Provincial Assembly)
• Three administrative divisions remain: Muzaffarabad, Mirpur, and Poonch
2. Judicial Architecture
• AJK Supreme Court abolished
• High Court of Jammu & Kashmir becomes the apex court
• Appeals will lie before the Supreme Court of Pakistan
3. Parliamentary Representation
A) Provisional Provincial Assembly
• Total 65 seats
• 41 active seats (35 general + 6 refugee)
• 24 seats reserved/vacant for Indian-Occupied Kashmir
B) National Assembly
• 8 seats (2 each from Muzaffarabad, Mirpur, Poonch + 2 special federal seats)
C) Senate
• 12 seats (equal representation with other provinces)
Requires amendments to Articles 1, 51 and 59 of the Constitution of Pakistan.
24 vacant seats claimed to protect UN resolutions and the right to self-determination.
