I ’m sick and tired of the H-1B industrial complex. Everyone seems to be making money—tech companies, universities, Indian outsourcing firms, and immigration lawyers—except U.S. citizens. Let’s all use the term H-1B INDUSTRIAL COMPLEX. @USTechWorkers @amandalouise416 @GavinWax

Want to be demoralized today? Head over to the H1B visa Reddit forum. They are still getting record approvals, PERMs, and finding new jobs in record time when being laid off. It seems to be smoke and mirrors what the Trump Administration is doing here.

Your daily reminder that the occupied Trump Administration is flooding our country with Hindus from India to replace American workers and is also allowing Blackrock [✡️] controlled companies to offshore a massive number of American jobs there.
It's high treason.

Oh, let me guess… Since the Attorney General decided today that companies can hire H1B‘s ONLY…. Americans are going to get millions more Indians dumped on us…..
…as part of this Trade Agreement!

We MUST chimp on this one. This is NOT ALLOWED. You cannot put “I’m only looking to hire Indians or Chinese” in your hiring advertisement. It’s illegal and outrageous; it’s an open declaration of economic war against Americans, against our own people. Will no one rid us of these corporations? Of our own Attorney General? Of the plague of caste monsters?
Donald Trump gives American workers the shaft, AGAIN.
The Attorney General interprets the law such that employers can put "Looking for H-1B" in ads at will.

🚨 UPDATE: TRUMP’s DOJ HAD A CHANCE TO FIX THIS. IT DIDN’T.
13 Republican lawmakers urged the Justice Department to intervene.
DOJ reportedly declined, allowing the ruling to stand.
Think about that.
An employer can advertise specifically for H-1B workers, yet the advertisement alone may not establish a violation of the citizenship-discrimination law.
American workers may need additional evidence of discriminatory hiring.
The administration says American workers come first.
Then why did DOJ let this ruling stand?
@DAGToddBlanche
immigration-analytics.com/20…
🚨 “NO U.S. CITIZENS NEED APPLY.”
Yes, you read that correctly.
A DOJ administrative law judge just ruled in a case involving Boston Consulting Group that a discriminatory job advertisement like this is NOT, by itself, a violation of the federal law protecting Americans from citizenship-status discrimination.
Think about how crazy that is.
If a company posts:
“H-1B WORKERS ONLY”
many Americans will simply never apply.
And according to this ruling, the ad itself may not be enough.
An American worker may have to APPLY, get rejected, and then prove they were rejected because of their citizenship.
The sign tells Americans not to apply.
Then the law may require them to apply anyway to prove discrimination.
DOJ itself has previously gone after employers for discriminatory job advertisements, including ads favoring H-1B and other visa workers.
Now there is a limited window for the Justice Department to act.
The author of a new analysis is calling on Deputy Attorney General Todd Blanche to step in and vacate or modify the ruling.
He should.
In 2026, there should NEVER be a legal loophole allowing an American company to advertise:
“NO U.S. CITIZENS NEED APPLY.”
@DAGToddBlanche, will DOJ fix this?

We've all heard about how American companies discriminate against American workers in favor of immigrants. But did you know it's illegal to discriminate in FAVOR of Americans?
We're calling for a repeal of 8 USC 1324b, which outlaws preferring American citizens in many cases.

A year ago I said the H-1B crisis was engineered.
This month Microsoft and Adobe got suspended from the green card sponsorship program. Then Vance went on national TV and said the problem is 'the company, which brings a person who sometimes will lay off an American worker.'
Washington is finally catching up.

🚨 NOW: Assistant AG Harmeet Dhillon and Trump's DOJ just made Instacart pay $5 MILLION for rigging its hiring process against American workers in favor of FOREIGN VISA HOLDERS
EVERY company is officially on notice! 👏🏻
Americans applying for these jobs had to MAIL in paper applications, while visa workers got to apply online
That ran from December 2023 to February 2026. Instacart now has to pay $4M to the Americans it shut out, plus $1M in penalties, and it'll be under a federal monitor.
This comes after the Trump admin SUSPENDED multiple firms' PERM program access for foreign labor.
Keep pushing, @HarmeetKDhillon! 🇺🇸

🚨 INSTACART JUST AGREED TO PAY $5 MILLION OVER DISCRIMINATION AGAINST AMERICAN WORKERS.
The DOJ and EEOC uncovered evidence of discriminatory hiring practices tied to the PERM green card process.
Here’s what investigators found:
• American applicants had to physically MAIL their applications.
• Instacart’s normal hiring process accepted online applications.
• Many American applicants were not considered in time.
• Investigators found evidence of preference for temporary visa workers.
The settlement includes:
$4 MILLION for affected applicants.
$1 MILLION in civil penalties.
And here’s the bigger story:
The PERM process is supposed to test whether qualified American workers are available before sponsoring a foreign worker for a green card.
What happens when the hiring process itself is stacked against Americans?
This is why PERM recruitment deserves scrutiny.

Congratulations to @JobsNowPR for exposing Instacart’s discriminatory practices aimed at discouraging U.S. citizens from applying for these jobs. @TheJusticeDept has reached a settlement with the company that will compensate U.S. job applicants who were discriminated against.
🚨 $5 MILLION SETTLEMENT: @USEEOC and @theJusticeDept @CivilRights secure major action against @Instacart for allegedly discriminating against American workers. Thank you to @AAGDhillon for your partnership in achieving this great result for a class of American workers, comprised of affected applicants and deterred applicants to Instacart.
The agencies found evidence that Instacart’s PERM recruitment practices favored temporary visa holders and created unlawful barriers for U.S. and American workers applying for jobs.
Up to $4 million will be available for affected applicants and deterred applicants, with an additional $1 million in civil penalties.

So happy to finally see justice for Americans job seekers Instacart unfairly discouraged from applying!

And here's another loophole most Americans don't know about:
Under 20 CFR § 655.737, even H-1B-dependent employers and willful violators can bypass the additional American-worker recruitment and non-displacement requirements if the foreign worker is paid just $60,000 annually OR has a master's degree.
That $60,000 threshold was established in 1998 and has NEVER been adjusted for inflation.
QUICK HISTORY LESSON: Why most H-1B employers never have to certify that no American can do the job
The modern H-1B program was created by the Immigration Act of 1990. During drafting, proposals that would have required employers to actively recruit U.S. workers and attest they could not find a qualified American were considered… and then DELIBERATELY dropped from the final bill.
Congress instead created the Labor Condition Application (LCA), which mainly requires attestations on wages (the higher of the actual wage paid to similar employees or the prevailing wage) and that working conditions will not be adversely affected. No routine labor-market test proving U.S. worker unavailability for ordinary employers.
The extra rules that do require good-faith recruitment of Americans and non-displacement attestations apply only to “H-1B-dependent” employers (generally those whose workforce meets size-based thresholds, such as 15%+ H-1B for larger companies) or prior willful violators.
Those provisions were added in 1998 by the American Competitiveness and Workforce Improvement Act. Most large tech companies do not meet the dependency test.
The full “unable to find a qualified, willing, and available American” recruitment process has always been required for PERM (permanent labor certification for most employment-based green cards), not for standard H-1B petitions.

WSJ: A Princeton PhD in chemical engineering applied to 2,300 jobs, ranging from postdoctoral fellowships to corporate science jobs and software engineering positions. He still hasn’t found a job. 34% of Americans surveyed by Gallup in August said it was a good time to find a quality job.
Meanwhile, Congress is fixated on finding a way to pass a bill that staples green cards to any international student who earns a PhD in the United States.
We should start by asking why our own graduates can’t find jobs before importing more workers.
