BREAKING: A MICHIGAN COURT JUST ORDERED BENSON TO TELL EVERY CLERK IN THE STATE TO KEEP THE NOVEMBER 3 POLL BOOKS. The Court's words to Jocelyn Benson, Michigan Secretary of State: "Defendants are directed to instruct all local election officials to retain the EPBs from the November 3 General Election." And Benson's deletion rule? "Defendants are precluded from enforcing Rule 168.48 pending the resolution of this matter." Benson's rule: DELETE the poll book files 7 days after the election is certified. Federal law: KEEP election records 22 months. One township clerk asked which law to follow. Nobody answered. So Michelle McQueer sued. In August, the Court protected her file, the ONLY one known to still exist, and barred enforcing the rule against her. Today it extended that protection to EVERY clerk in Michigan, on an additional request from the RNC and Michigan Republican Party, who joined her case this month. Glad to have them in the fight. Along the way, @TheJusticeDept and the @CivilRights division told the Court the Secretary "remains ultimately responsible" for preserving poll book data. And Benson's own data manager swore the list each precinct downloaded for Election Day "need not be uploaded." Reconstruction is not preservation. This isn't the final ruling. But no November poll book gets deleted while the judge decides. That's all one clerk asked for. ONE CLERK. ONE QUESTION. EVERY NOVEMBER POLL BOOK SAVED. PICK A CRIME: That's the choice Michigan Secretary of State Jocelyn Benson handed my client, a township clerk. A new state rule Benson made orders my client to DELETE the electronic poll book records of the August 4 primary within 7 days of certification. What’s the problem? Federal law orders her to KEEP those same records for 22 months, into 2028. Delete them? Face up to 1 year of imprisonment under federal law. Refuse? Up to 90 days imprisonment under Michigan law. Every path carries a penalty aimed at my client personally. For trying to follow the law. My client wrote Jocelyn Benson and the Director of Elections on July 6 and asked one question: how do I obey both? Thirty-seven days. NO ANSWER. So we asked a judge, while the records still exist. No more waiting around. Declare which law controls. Preserve the voting records. And the part that should get your attention: the same rule governs the NOVEMBER election. WATCH: @RobGouveiaEsq JUST BROKE DOWN OUR MOTION TO WIN AND THE JUSTICE DEPARTMENT'S STATEMENT IN MY CLIENT'S CASE: Grateful for the continued attention to this important case. Links below. Benson's rule: DELETE the poll book files 7 days after the election is certified. Federal law: KEEP election records 22 months. One township clerk asked which law to follow. Nobody answered. So Michelle McQueer sued. Won a TRO. Also beat the State's motion to toss the case. Her August file is the ONLY one known to still exist. November’s records are next. Our motion to win shows what's erased using the State's OWN documents. Their answer? Benson's own data manager just swore the list each precinct downloaded for Election Day "need not be uploaded" to the state database. Why? "It would be duplicative." (Clone Aff, par 14) Their theory: the State tracks every change, so the list can be rebuilt later. Here's the thing. Reconstruction is not preservation. It’s DELETION with a RECEIPT. The next day, the United States filed in the case and told the Court that poll book data are federal election records, and the Secretary of State is responsible for keeping them. It also said that IF the Secretary is right that everything gets uploaded, prosecuting the clerks who deleted wouldn't be a priority. But own data manager just swore it doesn't all get uploaded… Delete or keep? The court record is now complete and now the judge decides. Our Motion to Win: tinyurl.com/PollbookClerkMot… The State's New Affidavit: tinyurl.com/PollbookCloneAff… Our Response to the New Affidavit: tinyurl.com/PollbookAffidavi… The U.S. Statement of Interest: tinyurl.com/PollbookUSStatem… Let's make Michigan safe, normal, and responsible again! 🇺🇸 @MIGOP @MI_Republicans @Th_Midwesterner @MINewsSource @stevegrubershow @MrJustinBarclay @JonathanTurley @downi75 @Mike_Cox @MrAustinPredict @gatewaypundit @honestpollster @mifairelections @dcexaminer @MZHemingway @jsolomonReports

THE JUSTICE DEPARTMENT JUST WEIGHED IN ON MY CLIENT'S CASE. Its message to the Court: poll book data are federal election records, and the Secretary of State is responsible for keeping them. That's a rare move. And it's what Bridgewater Township Clerk Michelle McQueer has been saying for a year. Benson's rule: DELETE the poll book files 7 days after the election is certified. Federal law: KEEP them 22 months. Michelle asked which law to follow. Nobody answered. So she sued. Her August file is now the only one known to still exist. Every other clerk deleted theirs. And the day before DOJ filed, Benson's own data manager swore in a filed affidavit that the list of voters each precinct used on Election Day is NEVER copied into the state database. READ THAT ONE TWICE. We didn't invite anyone in. We didn't oppose anyone coming in. One clerk asked one question: delete or keep? The judge decides. Read about it in the @gatewaypundit. Let's make Michigan safe, normal, and responsible again! 🇺🇸 @MIGOP @MI_Republicans @Th_Midwesterner @MINewsSource @stevegrubershow @MrJustinBarclay @JonathanTurley @RobGouveiaEsq @downi75 @Mike_Cox @MrAustinPredict @gatewaypundit @honestpollster @mifairelections @dcexaminer @MZHemingway @jsolomonReports
The U.S. Department of Justice has taken the highly unusual step of filing a Statement of Interest in a Michigan trial-court case — telling the Court of Claims that electronic poll book data, including all metadata, are federal election records and that Secretary of State Jocelyn Benson is responsible for preserving them. Statements of Interest from the Justice Department in pure state-court cases are rare. It is even rarer for DOJ to intervene at the trial-court level rather than on appeal. It is rare for the department to appear in a state trial court at all. The only recent election example is a 2022 Wisconsin circuit court case over absentee ballot witness addresses. MICHIGAN’S DIRECTOR OF ELECTIONS SWORE A CLERK CAN STILL GET THE DELETED POLL BOOK DATA FROM THE STATE. WE LOOKED… AND IT'S NOT THERE. Our motion to WIN this case is on file. Today we filed our answer to their second motion to dismiss. Every document is linked below. The electronic poll book is the record of everyone who checked in to vote at your precinct. Michigan Secretary of State Jocelyn Benson's new rule says DELETE it 7 days after the election is certified. Federal law says KEEP it 22 months. No matter what option she picks, she’’s FORCED by Benson to commit a crime. My client, Bridgewater Township Clerk Michelle McQueer, sued August 12. Won a TRO August 27. Beat the State's first motion to toss the case September 22. She is now the ONLY clerk in Michigan who still has her August 4 file. OUR MOTION: Table 1 in our brief lays it out side by side, row by row: what the poll book file holds, what Benson's rule DELETES, and what the State keeps instead. Two rows decide the case. The time of every check-in, to the second. And the account that made it. The file to be deleted has both. NOTHING the State keeps has either one. The State's own retention schedule even calls this data "records.” THEIR MOTION: Their lead argument STILL isn't that Benson’s rule is legal. It's that the judge lost jurisdiction the day the Bureau finally answered Michelle. ELEVEN MONTHS after the first clerk asked. Nonsense. OUR ANSWER: This judge already ruled September 22 that the case was properly brought. And the same week, the State told a FEDERAL judge that this Court's order "is binding on the Secretary of State." Then told this judge he has no jurisdiction. UNDER OATH: Benson's Director of Elections swore the Clerk "can access the activity log by running a report in the QVF." (Brater Aff, par 24) Guess what? My client ran it. The State's own report: just a DATE. NO time. NO user. Next paragraph: "not all technical data contained within the QVF is accessible to all users or the public." (par 25) READ THAT AGAIN. THE RNC: The Court admitted the RNC and Michigan Republican Party to the case October 5 as intervening plaintiffs. They filed a notice JOINING Michelle's motion. The national party put its name on a township clerk's brief. Glad to have them in the fight! ONE CLERK. ONE FILE. THE STATE'S OWN REPORT SHOWS WHAT'S MISSING. - Our Motion to WIN (public version): tinyurl.com/PollbookClerkMot… Some pages are redacted. At the State's request, the Court sealed 34 pages of the Bureau's own user manual. The judge has the full version. - Benson's Second Motion to Dismiss (first one failed): tinyurl.com/PollbookBensonOc… - Our Response to their second motion: tinyurl.com/PollbookClerkAns… Let's make Michigan safe, normal, and responsible again! 🇺🇸 @MIGOP @MI_Republicans @Th_Midwesterner @MINewsSource @stevegrubershow @JonathanTurley @RobGouveiaEsq @Charlieleduff @downi75 @Mike_Cox @MrAustinPredict @cspiesdc @gatewaypundit @RNCVoteProtect @mifairelections @dcexaminer @EagleEdMartin @HarmeetKDhillon @MZHemingway @jsolomonReports @Republicans @RapidResponse47
BENSON ORDERED CLERKS TO DELETE ELECTION RECORDS. A CLERK SUED. BENSON ASKED A JUDGE TO THROW IT OUT. TODAY HE SAID NO. ON EVERY GROUND. THE CASE IN 30 SECONDS The electronic poll book is the laptop record of everyone who checked in to vote at your precinct. Michigan Secretary of State Jocelyn Benson's new state rule says clerks must DELETE it 7 days after the election is certified. Federal law says KEEP it 22 months. Destroying it early is a FEDERAL CRIME. My client, Bridgewater Township Clerk Michelle McQueer, asked the State which law to follow. ELEVEN MONTHS. NO ANSWER. So she sued. WHAT HAPPENED TODAY: - The Court of Claims denied the State's motion to dismiss. COMPLETELY. - The State said she waited too long. DENIED. The court: it "cannot fault plaintiff for waiting." The power to answer her "was completely in their hands." (pp 19, 21) - The State said she skipped the process. DENIED. The court: it "will not support defendants delaying in resolving the administrative proceedings and then fault plaintiff for filing suit." (p 19) - The State said a clerk can't bring this case in any court. DENIED. The court: she sued "to ensure that she ... complies with state and federal law and therefore will not be criminally charged." That's not the kind of case the State's cases are about. (pp 21-22) - And the order protecting her records STAYS IN PLACE. WHAT THE JUDGE WROTE: The State said criminal liability is "speculative" because DOJ hasn't prosecuted anyone yet. The judge, in Footnote 3: "The Court finds this contention to be quite remarkable and reckless." And Footnote 5: "Plaintiff's suit also could derivatively save the SOS from being criminally charged federally." READ THAT ONE TWICE. FROM THE HEARING, SEPTEMBER 16: - To the State's lawyer, first sentence: "Off the top, you lose on the laches." (p 5) - When Benson's lawyer argued the burden on the State: "You're arguing practicalities. But you know what? I have to comply with the law. I have to follow the law." (p 11) - On calling out the State's specious claim that a clerk can't bring this case: "I'm with you on that. You're right." (p 16) - The State's own lawyer, on the record: "You're not going to hear a merits argument from me." (p 11) WHAT'S NEXT: The State now has to defend the rule on the merits, which it has AVOIDED SINCE THE START. Benson's lawyers promised in court to issue rulings on her requests within two weeks. Once those land, both sides file, and the judge decides whether a state rule can order clerks to delete what federal law says to keep. ONE CLERK. TWO LAWS. A JUDGE WHO READS AND CARES ABOUT THE LAW. Full opinion (Sept22): tinyurl.com/pollbookruling Hearing transcript (Sept 16): tinyurl.com/pollbooktranscri… Let's make Michigan safe, normal, and responsible again! 🇺🇸 @MIGOP @MI_Republicans @Th_Midwesterner @MINewsSource @stevegrubershow @MrJustinBarclay @JonathanTurley @RobGouveiaEsq @downi75 @Mike_Cox @MrAustinPredict @gatewaypundit @honestpollster @mifairelections @dcexaminer @MZHemingway @jsolomonReports

DR. LARRY NASSAR IS NO LONGER A REGISTERED SEX OFFENDER IN MICHIGAN. Not a typo. Search his name on the state registry. One doctor. Hundreds of young victims. ZERO search results. Two Michigan Supreme Court seats are on your ballot in November. Here's why that matters. Last December, in People v Kardasz, five justices declared the sex offender registry "punishment." In a case where the defendant LOST anyway. They didn't need to decide it, and even one of their own colleagues said so. Nine months later, the court relied on that ruling to take Nassar and 20,000 others off the list. Just outrageous. Two of those five justices are on your ballot: Chief Justice Megan Cavanagh and Justice Noah Hood. The ballot says nonpartisan. Both were nominated by the Democratic Party. Justice Brian Zahra dissented in December. He said the majority paid "mere lip service" to the legal standard and that this decision belonged to the people's elected representatives, not the court. Zahra is what a RULE OF LAW justice looks like. And two judges on your ballot share his view of the job. Judge Michael Warren @mdwarrenjr. 24 years on the Oakland County bench, more than 400 jury trials, and he says courts shouldn't be making policy. Judge Casandra Morse-Bills @MorseBillsforMI. A sitting circuit judge who sentenced a man to 25 to 60 years for sexually assaulting a child. Yes, Nassar will die in prison. But 20,000 others came off the registry with him, and many of THEM aren't behind bars. And now you won’t know where they are. Two seats. Your ballot. Know the names. Vote for Warren and Morse-Bills this November. Let's make Michigan safe, normal, and responsible again! 🇺🇸 @MIGOP @MI_Republicans @Th_Midwesterner @stevegrubershow @MrJustinBarclay @PattyLovesTruth @Rescue_Michigan @elonmusk @mifairelections @TruckerRandy @DonnieDetroit19 @BobDinMI @MrAustinPredict
Larry Nassar removed from Michigan sex offender list. Details: tmz.com/2026/10/01/larry-nas…
Readers added context they thought people might want to know
Due to being held in an out of state prison, Larry Nassar wasn’t ever on the Michigan Sex Offender Registry. If you are in not employed, in a domicile, going to school, or working you do not need to register. Similarly, if you are incarcerated you do not need to register. midmichigannow.com/news/local/lar… detroitnews.com/story/news/loc…

I can share the inside baseball here. Not one super PAC, nor Trump WH, has reached out to ask people, "Will you help us get out the vote?" There is a level of entitlement, and then rage when this entitlement is unmet, that I've never seen. Bot swarms seek to discredit anyone who suggests that the Republicans and PACs need to run a better game. It's some bizarre moral black mail scheme. I honestly don't know what people think it's been effective. I've only seen it backfiring. There are people who have gotten generational wealth by "lobbying" and "consulting" in ways that the general public might find less than ideal. Some of these people are lashing out at anyone who doesn't toe the line, but who have they helped with their newfound wealth? They have not done anything to fund legal defense group for staffers who will face lawfare. Those groups are woefully underfunded. Very good people with new families are already losing sleep. This is unacceptable. Everyone knows that insiders stick their beak in once their guy wins, and the Green New Deal slush fund makes a lot of this stuff seem like small potatoes. In any case, people talk, everyone knows everything going on in DC. Some, like myself, don't "call it out," because that only helps Democrats. Calling this hypocritical or whatever wouldn't offend me. I am not a priest or pastor or exemplar of morality. Balancing independent reporting and analysis while not wanting to turn the country over to people who seek to murder children is a line I challenge all of my critics to walk. See what it's like and the feedback you get. Downstream it's the voters who get screwed, and that's the only reason I haven't totally checked out this cycle. I hope people vote Republican. I've said this repeatedly. But the lack of basic courtesy one would expect has been jarring. We do this for the country, but also are "only human." When you get nothing but nastiness from people getting rich by riding the waves you create, you are left wondering, "What the hell am I doing with my life?" My loyalty is always firstly to the people who have read me over the years, as these are the people who want to save civilization, they receive no thanks or recognition, they are expected to eat shit while the big donors get their way. That is the only reason I am still here. If this were truly only about politics, or if this were my career, I'd have left. Every day I want to leave, every day I wake up and wonder why bother. And before the usual suspects go, "Waaah." It's quite the opposite. People are whining to me, "Do more! You can't sit this out!" Many of these folks recently called me "irrelevant." Suddenly I'm supposed to, without being apologized to, or politely asked, shill for the midterms 24/7. You can't treat people this way and expect to win like it's 2024 again. And I speak for a lot of people. Not merely those in my shoes or others, but the voters who lost friends, business opportunities, and sometimes their own freedom, for putting on the MAGA hat. Ignore my concerns if you like, but this isn't stuff unique to me nor is it new.

The reason I started a speaking tour this year Politics is too important to be left to politicians -- or to consultants who get paid either way
Guys, I hate to break it to you, but most political advisors are so bafflingly incompetent, it would make your head spin. All the talented communicators go work in Hollywood or at Saatchi and Saatchi, and these political bros never tap these agencies for help...I've connected several campaigns with literally the best marketing geniuses in the game, got them discounted rates, even...and they just never even bothered calling. It truly feels like a lot of consultants and candidates just want to lose. You ever wonder how my ads went so massively viral, but there's not been a single candidate who's come close to it? It's their dumbass advisors. I didn't go with any political advisors, and they were SO mad about it. I partnered with a filmmaker and marketing wizard, instead of political grifters. Why? Because I wanted our messaging to be effective. Political ads suck. Nobody watches them. I wanted people to want to watch my ads. The fact that nobody else understands this is...I honestly don't know how to explain it, other than they want to lose. There are a bunch of candidates who love it when their party loses power. It takes all the heat off them, because then they can't be expected to pass legislation when they're in the minority, plus they can fundraise way better off of the rage when the opposition is running roughshod over the country. Baffling to watch.

MICHIGAN REPUBLICANS ARE TRUSTED LESS ON THE COST OF LIVING. EVEN PART OF THEIR OWN BASE ISN'T SOLD. HERE'S THE FIX. @mich_enjoyer commissioned this one and did it fairly. A REPUBLICAN pollster and a DEMOCRATIC pollster ran it together. 35% Republican, 37% Democrat. 40% identified as conservative. Nobody waves it off. Top issue: cost of living, 24%. Then taxes, 10%. A third of the electorate voted with their wallet. On cost of living, Democrats are trusted more, 41 to 34. On energy bills, Democrats by 5. On healthcare costs, Democrats by 12. SEVEN POINTS on the number one issue, in a room that isn't stacked against us. That's why the GOP base isn't moving. Democrats outvoted us by 564,000 in August. Base voters are hearing "socialism." What they want is a lower electric bill, insurance they can afford, and rent that doesn't eat the paycheck. That IS the cost of living. And an evenly divided room just said it trusts the other side on all three. When the message doesn't match the want, nobody gets in the car. I'm saying it because there's still time. Nobody drives to the polls to vote AGAINST. They drive to vote FOR. "Socialism" doesn't get our base voters off the couch. A PLAN with a NUMBER does. 35 days. Ballots are in mailboxes. Tell them. Here's what your electric bill drops to. Here's what you'll pay for insurance. Here's the plan for rent. A number next to each. The voters already told us what they want. SAY IT. You're right about the tradition and, respectfully, you're still wrong about the law. Anonymous speech goes back to Publius and the Federalist Papers, and the Court still protects it: anybody can hand out a leaflet without signing it. 51(3) doesn't touch that. Spend under $5,000 and nobody asks your name. But the Court drew a line inside that tradition fifty years ago, between a person speaking and money buying election ads. Scalia put it this way in Doe v. Reed: standing behind your political acts "fosters civic courage, without which democracy is doomed." That same year, Citizens United was asked whether the old tradition protects anonymous ad spending. It said no, 8 to 1. Scalia wasn’t wrong. First Choice didn't move that line. It let one charity into federal court to fight a subpoena. That's all it decided. It was a standing case. Publius wrote essays. He didn't buy $5,000 of ads naming a candidate a month before the vote. The Court has always known that difference.
