Some unbelievable heavy artillery being exchanged between the majority and the dissenters here.
An en banc decision from a 17 judge court, with a 10-7 split, we get a majority opinion, three concurring opinions, and two dissenting opinions.
Combined they total 157 pages.
FAR too much to dissect today.
BUT, this cases raise the sole issue that was remaining on detaining illegal aliens caught in the country will removal proceedings are conducted -- whether the Due Process Clause of the Fifth Amendment requires that they be given a bond hearing even if the statutory language used by Congress specified otherwise.
The cases SCOTUS has agreed to take up involve only what the statute's require in terms of a bail hearing -- not whether due process requires one even if the statutes do not.
But some Judges granting bail hearings have entered alternative rulings when ordering the release of aliens while removal proceedings are underway. Their orders state that even if they are wrong on what the statute requires, the 5th Amendment Due Process clause requires a hearing before liberty can be deprived for such aliens.
This en banc decision by the Fifth Circuit raises the issue -- which the SCOTUS could now decide to take up at the same time it is going to the statutory cases.

She posted an NSA security warning alongside claims about Google, military systems and emergency banking meetings. She then put that warning at the end of a timeline beginning with a October third video.
But the warning concerned security flaws in PHP software used to run websites.
The people fixing those flaws published their own timeline:
July 30: Their investigation began.
August 11: A serious flaw was reported, and fixing it became a top priority.
August and September: Other researchers reported additional ways to exploit it.
October 21: The fixes were released.
That work was underway well before her junk video.
October 21st was when the fixes became public. It wasn’t when researchers first discovered the problem.
The NSA warning does not confirm her propaganda Fort Huachuca guest list, her claim about emergency banking meetings, or any connection to her imaginary investigation.
Putting events in date order doesn’t establish that one caused the next.
