Not one single person invited by LCAG to meet with the APPG on 2nd December, to discuss the outcome of the McCann Review, was someone who’d agreed a settlement only to find that astonishingly the ex-CIOT President then recommended better terms for those who hadn’t!

I’ll bet the ex-APPG secretariat @HMRCVictim does not disclose to @DanNeidle that @LCAG_2019 & @WTTconsult sold non-disclosure of #loancharge liabilities such that McCann has now given better terms to those who simply chose not to settle by the deadline 6 years ago of 30/9/2020

The “right to be heard in court”, which Dan says is about extracting more fees (he should know as a tax lawyer), is a statutory right that was argued for until the #loancharge rendered it otiose. The only ones still arguing for this right are WTT & LCAG (who are sold to by WTT)!

The reason that the right to go to Court is otiose is because HMRC introduced a retrospective #loancharge which would create a tax charge even if the Courts ruled against HMRC. HMRC said “we win or we win, clever isn’t it”. People have taken their own life due to this charge.
HMRC propose a new law that will bankrupt those they refer to as customers. HMRC employ behavioural scientists so have no excuse for not knowing the mental health damage of destroying people’s life with no chance for them to make their case. The CEO gets a knighthood #loancharge

Those who DID KNOW they were borrowing under loans, per Dan’s definition, must then have been a knowing party to fraud. That includes some LCAG directors. No other way you can read Dans claims. Spoiler: Dan’s claims are entirely contrary to the Court findings or Review findings.

Clairol claims Promotors talked of schemes being approved, but not one person has ever provided any evidence of this (see attached). Clairol says they're not £60k people yet LCAG's big gripe is the Review discount being limited to 'only' £70K. Nothing they say hangs together.

Loans should only be written-off on settlement of income tax otherwise it triggers the equivalent of a PAYE charge under s188 (as happened to WTT clients!). But remember Armadillo submitted a Proposal in 2020 which included how to prevent loan recalls, but LCAG torpedoed it.
Yes indeed, the Government could have resolved this, but chose to ignore it because they don’t give a damn. All they needed to do was give a written cast iron guarantee to waive IHT on loans then people would have had them written off & make it illegal to sell off the loan book

Unwilling to settle (due to false beliefs) - not unable to settle. Richard was at the APPG meeting last week so he probably got that straight from LCAG. Dan tells him they are talking rubbish. But we discovered previously that Richard only hears what he already believes.

Nobody ever states the obvious. That if someone on over £60k pa signs a NMW contract & a loan agreement (then receives monthly payslips showing only the NMW & a separate loan payment each month with annual loan statement), now claims it was fraud...then they must be party to it.

These loans were examined between 2012 & 2017 by the FTT, the UTT, the Court of Session & the Supreme Court and nobody argued it was fraud. Some people think they know better than the judiciary. Remarkably some of those are the people who signed up for & benefitted from schemes.

HMRC had just lost in the First Tier Tax Tribunal when they undertook a behavioural psychology experiment to get people with a legitimate tax dispute to throw in the towel. Dan, a tax lawyer, says it’s okay for HMRC to circumvent the Courts when the result doesn’t go their way.

At the time of the behavioral psychology experiment by HMRC in 2012 "to encourage users to withdraw from the scheme", HMRC had just been defeated in it's arguments v Rangers in the FTT (Murray Group Holdings). The case law at that time did not support HMRC applying a PAYE charge.

The FTT decision against HMRC was in October 2012. In December 2012 HMRC conducted a behavioral psychology experiment to get users to concede to tax regardless of the Court decision. One example of the four different letters is below. Nowhere does it mention the Court ruling.

Arguably Employers NI is specifically a tax on people working.

Current settlement terms mean those who disclosed their loans will pay more than those who did not. That discourages compliance. HMRC should amend settlement terms to remove interest, APN Penalties & IHT to ensure that those who disclosed are not penalised over those who didn’t.
Trevor is Sussex LC Group isn’t he, despite his pretence. Trevor is now an LCAG director & another gullible member of what WTT are selling.

As a Director of LCAG & someone who thinks themselves knowledgeable enough to write #loancharge articles as if they were factual, what does Trevor believe? Trevor wanted a tax deduction for something not being taxed (until LCAG’s misguided argument). Is this a priority for LCAG!

In 2019 WTT said they would "develop a safe haven for loans". Was this just yet another unfulfilled promise? Did WTT help you move or write-off your loans? #loancharge

It’s a travesty that those with pre-DR loans haven’t been offered these improved terms. Nor have those who stretched themselves to the limit to settle by the 2020 deadline & who may still be paying & still in danger of default. Some struggled to pay the tax but still face fhe IHT

The body speaks (unconsciously). Watch him shake his head each time he makes a false claim. It’s almost comical.
Is this a parody account? Founders Tax is a proper chocolate fireguard.
